The obligation to license standards essential patents on'Fair,Reasonable and Non-discriminatory'( F / RAND rule) terms are designed to eliminate the potential for 'holdup ' brought by patentees whose patents are thereafter asserted at unreasonable rates,and to fully compensate these patentees on'fair,reasonable and non-discriminatory'terms. Due to the globalization of manufacturing and technology, differing national approaches towards standardization and the role of the market,and the ambiguity of the F / RAND concept itself,related litigations occur quite often in major jurisdictions for emerging new technologies,such as those incorporated into smart phones and cellular networks. As the first decision in which the license rates were determined all over the world,Huawei *** has had a great impact both home and abroad. Starting with a briefing and analysis of the Huawei decision,while making reference to the relevant decisions in the United States,the European Union,Japan and other jurisdictions,this article studies such significant issues as the definition, values, determination of F / RAND license rates and interventions thereto by antitrust laws in China, and provides some suggestions for the improvement of the F / RAND rule both in China and in other markets.

Because of its commitment to keeping the digital contents accessible, institutional repository plays an important role in the long-term preservation of intellectual output of the institution. However, digital preservation in institutional repository is faced with severe legal issues, especially the intellectual property problems. This paper focuses on the copyright issues involved with long-term preservation of digital resource in institutional repositories. It begins with a brief introduction to the relationship between the institutional repository and digital preservation. Based on this background information, the paper analyzes the related laws and regulations in China that affect the long-term preservation of digital resource in institutional repository. Then the authors discuss in details what kind of the copyright risk there may be, if we realize the long-term preservation of digital resource in institutional repositories. There may be different legal hazards, according to the various types of the digital output collected by institutional repository. The paper ends up with several suggestions to avoid the legal risk in digital preservation of institutional repository. Firstly, to utilize fair use is a feasible way. Secondly, also most safely, is to get the permission from the copyright owner. This is involved in the long-term preservation contract and open license.

Fault detection in optical burst switching （OBS） networks will be a challenging task in the future. A novel mechanism based on probe burst （PB） and a new key concept is proposed to detect faults of OBS networks by sampling the health of data channels, which solve the difficulty of optical monitoring schemes while keeps the transparency of data network to Internet protocol （IP） packets. It takes full advantage of the characteristics of OBS, including architecture and signalling scheme, and introduces the excellent performances of single-hop-test used in electrical communication networks into OBS environment while avoids the shortcoming that any optical burst must undergo an optical-electric-optical （OEO） conversion. Well designed PB can provide exact criterion for judging whether protection/restoration should be excuted according to hard or soft fault identification.

intellectual property is highly valued the world over,including in *** Decision on Some Major Issues Concerning Comprehensively Deepening Reform,released in November 2013 at the Third Plenary Session of the 18th Communist Party of China（CPC）Central Committee,said explicitly：＂We will strengthen the application and protection of intellectual property rights（IPR）,improve the technological innovation incentive mechanism,and explore ways to set up IPR courts.＂ On August 31, 2014, the National People＇s Congress, China＇s top legislature, voted to establish IPR courts in Beijing, Shanghai, and Guangzhou. They soon came into being, constituting a milestone in China＇s IPR protection.
