RULEMAKING POSSIBILITIES： EFFORTS OF THE UNITED STATES jUDICIAL CONFERENCE ADVISORY COMMITTEE ON EVIDENCE RULES TO ADDRESS THE CHALLENGES TO FORENSIC EXPERT TESTIMONY

This piece is an echo to one of the main subjects of the Sixth International Conference on Evidence Law and Forensic Science which is to determine what evidentiary reforms are necessary for regulating forensic expert testimony, and how those reforms might be implemented. In United States, the predominant way of evidentiary reform is through rulemaking. As the Reporter of judicial Conference Advisory Committee on the Federal Rules of Evidence since 1996, the author, with a pragmatic spirit throughout the article, examines such an effort at the federal level of U.S. in six parts （levels）, starting from the most general, abstract level till fmishing with the most detailed and substantive points. Part I begins with a brief introduction of the hierarchies of evidentiary rulemaking authorities at the federal level of the United States, various interested groups and their interesting interactions in the rulemaking process. The author then shifts to the general topic of writing rules with a specific focus on the level of detail that is to be provided in doing so; Part II further narrows down the scrutiny into writing a rule on forensic expert testimony with an emphasis on the necessity of making such a rule change to the current general standards of FRE; Part III directly addresses the challenges of drafting a rule on forensic evidence in FRE, including a comparation of various alternative drafting models; Part IV and Part V respectively discusses the Reporter＇s comments and the justice Department＇s concerns over the drafted rules; and Part VI briefly discusses the feasibility and effectiveness of a Best Practices Manual on forensic evidence in lieu of rulemaking.

The arms race between Magnaporthe oryzae and rice: Diversity and interaction of Avr and R genes

Rice blast disease, caused by Magnaporthe oryzae, threatens global food security. The rice blast pathosystem is a longstanding model system for understanding plant-microbe interactions. In order to elucidate the coevolution of the host and pathogen, and provide the appropriate methods for preventing or controlling rice blast disease, researchers have focused on the evolution of virulence factors and resistance genes. Thus far, more than 30 rice blast resistance（R） genes and 12 avirulence（Avr） genes have been cloned. This review summarizes the cloned rice blast R genes, cloned Avr genes of M. oryzae and the interaction between them. This discussion also considers some of the major unanswered questions concerning this pathosystem and the opportunities for future investigations.

Geophysical and orbital environments of asteroid 4692192016 HO3

Asteroid 469219 Kamo'oalewa,also named 2016 HO3,is a small-size fast-rotating near-Earth asteroid,which is a potential target for future *** to its weak gravity and fast spin rate,the dynamics on the surface or in the vicinity of 2016 HO3 are significantly different from those of planets or other small bodies explored in previous *** this study,the geophysical and orbital environments of 2016 HO3 were investigated to facilitate a potential mission ***,the geormnetric and geopotential topographies of 2016 HO3 were examined using difterent shape *** liftoff and escape conditions on its fast-rotating surface were ***,the periodic orbits around 2016 HO3 were studied in the asteroid-fixed frame and the Sun-asteroid frame considering the solar radiation *** stable regions of the terminator orbits were discussed using different ***,the influence of the nonspherical shape on the terminator orbits was *** precise terminator orbits around a real shape model of 2016 HO3 were obtained and verified in the high-fidelity *** study shows that the polar region of 2016 HO3 is the primary region for landing or sampling,and the terminator orbits are well suited for global mapping and measurements of 2016 *** analysis and methods can also serve as references for the exploration of other small fast-rotating bodies.

The N-terminus of COX-1 and its effect on cyclooxygenase-1 catalytic activity

Cyclooxygenases are encoded by COX-1 and COX-2. They share over sixty percent sequence identity in human and are similar to each other in their crystallographic structures. One major difference in the primary structure of these two isozymes is the presence of eight amino acids in the amino-terminal region of COX-1 that are not present in COX-2. The function of this amino acid sequence is unknown. In this study, a human COX-1 mutant （Δ7aa） with this sequence removed was studied in parallel with COX-1. Signal peptide cleavage, N-linked glycosylation, protein expression, distribution and dimerization were not affected by the mutation. The mutant was enzymati-cally active and showed the same sensitivity toward aspirin. The KM for the enzyme remained the same as COX-1. However, the Vmax of the COX-1 mutant decreased by 3.3-fold. We conclude that the COX-1 specific amino-terminal sequence has a subtle but detectable effect on COX-1 catalysis.

Safe growth of graphene from non-flammable gas mixtures via chemical vapor deposition

Chemical vapor deposition has emerged as the most promising technique for the growth of ***, most reports of this technique use either flammable or explosive gases, which bring safety concerns and extra costs to manage risk factors. In this article, we demonstrate that continuous monolayer graphene can be synthesized via chemical vapor deposition technique on Cu foils using industrially safe gas mixtures. Important factors, including the appropriate ratio of hydrogen flow and carbon precursor,pressure, and growth time are considered to obtain graphene films. Optical measurements and electrical transport measurements indicate graphene films are with comparable quality to other reports. Such continuous large area graphene can be synthesized under non-flammable and non-explosive conditions, which opens a safe and economical method for mass production of graphene. It is thereby beneficial for integration of graphene into semiconductor electronics.

Network analysis to inform invasive species spread among lakes

Often facilitated by human-mediated pathways,aquatic invasive species are a threat to the health and biodiversity of global *** present a novel approach incorporating survey data of watercraft movement in a social network analysis to reconstruct potential pathways of aquatic invasive species spread between *** an example,we use the green alga Nitellopsis obtusa,also known as starry stonewort,an aquatic invasive species affecting the Great Lakes region in the United States and *** movement of algal fragments via human-mediated pathways(i.e.,watercraft)has been hypothesized as the primary driver of starry stonewort *** used survey data collected at boat ramps during the 2013 and 2014 openwater seasons to describe the flow of watercraft from Lake Koronis,where *** was first detected in Minnesota,to other lakes in the *** results suggest that the risk of *** expansion is not highly constrained by geographic proximity and management efforts should consider highly connected *** human movement via network analysis may help to explain past and future routes of aquatic invasive species infestation between lakes and can improve evidence-based prevention and control efforts.

Epigenetics and pancreatic cancer:Pathophysiology and novel treatment aspects

An improvement in pancreatic cancer treatment represents an urgent medical goal. Late diagnosis and high intrinsic resistance to conventional chemotherapy has led to a dismal overall prognosis that has remained unchanged during the past decades. Increasing knowledge about the molecular pathogenesis of the disease has shown that genetic alterations, such as mutations of K-ras, and especially epigenetic dysregulation of tumor-associated genes, such as silencing of the tumor suppressor p16ink4a, are hallmarks of pancreatic cancer. Here, we describe genes that are commonly affected by epigenetic dysregulation in pancreatic cancer via DNA methylation, histone acetylation or miRNA (microRNA) expression, and review the implications on pancreatic cancer biology such as epithelial-mesenchymal transition, morphological pattern formation, or cancer stem cell regulation during carcinogenesis from PanIN (pancreatic intraepithelial lesions) to invasive cancer and resistance development. Epigenetic drugs, such as DNA methyltransferases or histone deactylase inhibitors, have shown promising preclinical results in pancreatic cancer and are currently in early phases of clinical development. Combinations of epigenetic drugs with established cytotoxic drugs or targeted therapies are promising approaches to improve the poor response and survival rate of pancreatic cancer patients.

Theoretical potential for low energy consumption phase change memory utilizing electrostatically-induced structural phase transitions in 2D materials

Structural phase-change materials are of great importance for applications in information storage *** driven structural phase transitions are employed in phase-change memory to achieve lower programming voltages and potentially lower energy consumption than mainstream nonvolatile memory ***,the waste heat generated by such thermal mechanisms is often not optimized,and could present a limiting factor to widespread *** potential for electrostatically driven structural phase transitions has recently been predicted and subsequently reported in some two-dimensional materials,providing an athermal mechanism to dynamically control properties of these materials in a nonvolatile fashion while achieving potentially lower energy *** this work,we employ DFT-based calculations to make theoretical comparisons of the energy required to drive electrostatically-induced and thermally-induced phase *** theoretical limits in monolayer MoTe2 and thin films of Ge_(2)Sb_(2)Te_(5),we find that the energy consumption per unit volume of the electrostatically driven phase transition in monolayer MoTe2 at room temperature is 9% of the adiabatic lower limit of the thermally driven phase transition in Ge_(2)Sb_(2)Te_(5).Furthermore,experimentally reported phase change energy consumption of Ge_(2)Sb_(2)Te_(5) is 100–10,000 times larger than the adiabatic lower limit due to waste heat flow out of the material,leaving the possibility for energy consumption in monolayer MoTe2-based devices to be orders of magnitude smaller than Ge_(2)Sb_(2)Te_(5)-based devices.
