数字服务合同单方变更权之规制

数字服务提供者常态化更新用户协议和应用程序。司法实践也认可其享有一般的、开放性的单方合同变更权,由此引发单方变更权与契约严守原则之间的冲突。并非任何改变均属于合同变更,不改变给付关系的日常更新不属于合同变更,不应过度夸大单方变更权的必要性。《电子商务法》《个人信息保护法》等法律并未确立数字服务提供者的单方合同变更权,唯有预先约定的单方变更权,才为法秩序所认可。在司法适用上,应通过格式条款规则规制约定的单方变更权条款,数字服务提供者应具体指出变更的情形、内容与影响,征得相对人的单独同意,并且自证变更权条款的合理性。数字服务提供者依约单方变更合同的,相对人也享有一定条件下解除合同的权利,且在合同解除后可以请求删除收集的个人信息,即使个人信息为服务的对价。

目的探讨不同剂量硼替佐米联合化疗治疗多发性骨髓瘤(MM)的效果。方法前瞻性病例系列研究,选取2022年2月至2023年5月乐山市人民医院收治的81例MM患者作为研究对象,按照随机数字表法将患者分成高剂量硼替佐米组(采用硼替佐米1.6 mg/m^(2)联合地塞米松及沙利度胺治疗,39例)和低剂量硼替佐米组(采用硼替佐米1.3 mg/m^(2)联合地塞米松及沙利度胺治疗,42例)。比较两组患者治疗4个疗程后临床疗效、不良反应发生情况、治疗前后C反应蛋白、β_(2)-微球蛋白和血肌酐水平及生存预后。结果高剂量硼替佐米组男性29例,女性10例,年龄(59±5)岁;低剂量硼替佐米组男性31例,女性11例,年龄(59±6)岁。两组基线资料比较,差异均无统计学意义(均P>0.05)。高剂量硼替佐米组与低剂量硼替佐米组总有效率分别为87.2%(34/39)、80.9%(34/42),差异无统计学意义(χ^(2)=0.58,P=0.446);高剂量硼替佐米组与低剂量硼替佐米组不良反应发生率分别为30.8%(12/39)、19.0%(8/39),差异无统计学意义(χ^(2)=1.49,P=0.222);治疗前两组C反应蛋白、β_(2)-微球蛋白及血肌酐水平比较,差异均无统计学意义(均P>0.05);治疗后高剂量硼替佐米组与低剂量硼替佐米组的C反应蛋白[(23.6±2.2)g/L比(31.5±3.6)g/L]、β_(2)-微球蛋白[(2317±63)μg/L比(4212±114)μg/L]及血肌酐[(70±5)μmol/L比(79±7)μmol/L]水平比较,差异均有统计学意义(t值分别为4.28、18.29、4.00,均P<0.05),且两组治疗后3项指标水平均较治疗前低(均P<0.05)。治疗后随访1年,高剂量硼替佐米组与低剂量硼替佐米组的病死率分别为10.3%(4/39)、14.3%(6/42),差异无统计学意义(χ^(2)=0.30,P=0.582)。结论高剂量硼替佐米联合化疗治疗MM疗效及安全性与低剂量硼替佐米联合化疗相当,但可有效改善MM患者的肾功能及炎症状态。

This is the third one of the paper series on the strike slip earthquake generating structure in the interior of the Chinese mainland. The features of the tectonic stress field of strike slip earthquake generating structure were discussed in the first paper (huan et al ., 1994), and the features of the deformation field of strike slip earthquake were presented in the second paper (Hun et al ., 1994). In the first section of this paper, through the analysis of the strike slip earthquake generating structure of several dozen large earthquakes with magnitude greater than 6.0, it is concluded that almost all strike slip earthquake generating faults are characterized by the oblique arranged distribution, and the barrier structure mode about the adhesive slip movement of strike slip is put forward; then in the second section, its four types, due to the different fracture form of the barrier at the ends, are also discussed; finally in the third section, the fracture terminating scale of the barrier of strike slip earthquake generating fault is also discussed.

In order to improve the signal-to-noise ratio of an all-fiber front-end system for high-energy pete-watt(PW)laser devices,we propose a method to restrain the noise by optical Kerr *** terms of analytical calculation,it is found that the signal-to-noise ratio can be increased by three orders of magnitude with the cell of pulse cleaning for the pulses,with the full width at half maximum TFWHM larger than ***,numerical calculation indicates that the group-velocity dispersion(GVD)may have a marked effect on the pulses with TFWHM smaller than 100 ps but larger than 5ps,with the help of self-phase modulation(SPM).This would debase the performance of the cell of pulse ***,we study the methods of restraining the distortion for the pulses with different peak powers to improve the performance of an all-fiber front-end system for high-energy PW laser devices,These results are of benefit to the experiments and the improvement of signal-to-noise ratio for high-energy PW laser devices.

Background: Many patients with chronic angina experience anginal episodes despite successful recanalization, antianginal and antiischemic medications. Empirical observations suggested that Shenzhu Guanxin Recipe Granules(参术冠心方颗粒, SGR), a Chinese herbal compound, exerted potential impacts on increased treadmill exercise performance and angina relieve. However, there has been no systematic study to clarify the impact of SGR on exercise tolerance in patients with stable angina. The SERIES(ShEnzhu guanxin Recipe for Improving Exercise tolerance in patients with Stable angina) trial is designed to determine the effects of SGR on exercise duration, electrocardiographic(ECG) evidence of myocardial ischemia, and incidence of major adverse cardiac events(MACE) in stable anginal patients. Methods: A total of 184 eligible patients with stable angina will be randomly assigned to receive placebo or SGR(10 g/day for 12 weeks) in a 1:1 ratio. The primary outcome will be the change from baseline in total exercise tolerance duration, time to onset of angina and ECG ischemia during exercise treadmill testing performed over a 12-week study period. The secondary outcome will include ECG measures, the occurrence and composite of MACE and the Seattle Angina Questionnaire score. Moreover, the coronary microcirculation will be evaluated to explore the possible effects in response to treatment of SGR. After the procedure, all participants will be followed up by interview at 3 and 6 months, enquiring about any cardiac events, hospitalizations, cardiac functional level and medication usage. Additionally, the occurrence of adverse events will be evaluated at each follow-up. Discussion: This study may provide novel evidence on the efficacy of SGR in improving exercise tolerance and potentially reducing clinical adverse events.

Dynamic response of the screen mesh is of great significance in the optimum vibrating screen *** this paper,based on the DEM-FEM co-simulation method,the effect of screening parameters on the dynamic response of the screen mesh is explored and the mechanism is revealed on the particle ***,a virtual experiment on a linear vibrating screen was carried out to analyze the screening pa-rameters'effect with both impact load and sustained stress inflicted on the screen ***,the time-domain evolution regularity of the screen mesh LVA(Local Vibration Amplitude)under different particle plugging conditions was investigated based on the ***,the influence of screening parameters on LVA and its distribution was *** results show that the screening parameters can greatly affect the screen mesh LVA and its distribution by changing the movement of the granular material and the particle penetration probability,which provides an important basis for the optimal design of the screen mesh and its supporting structure.
