保理交易中债权转让通知规则解释论

保理人进行债权转让通知不以债权让与人不履行通知义务为前提。应以确保保理人能够证实保理合同和应收账款转让事实为宗旨,确定构成保理人有效通知所需必要凭证的范围及标准;保理人提供经公证的必要凭证不应作为强制性规定。在能够确证应收账款转让事实时,保理人提起的诉讼或者仲裁应可构成有效通知,且应认可诉讼或仲裁方式的通知在最终判决前有阻止债务人向让与人履行的消极效力。应收账款转让登记不能替代转让通知,即使在应收账款多重让与的情形中,债权转让登记与通知的效力冲突亦可通过坚持转让通知优先主义规则得以化解。暗保理人向让与人行使追索权不应以向债务人通知债权转让为前提。

Macrophages are essential components of the innate immune system and constitute a non-specific first line of host defense against pathogens and *** regulate macrophage activation and innate immune responses in various inflammatory diseases,including cochlear *** distribution,number,and morphological characteristics of cochlear macrophages change significantly across different inner ear regions under various pathological conditions,including noise exposure,ototoxicity,and age-related ***,the exact mechanism underlying the role of mitochondria in macrophages in auditory function remains ***,we summarize the major factors and mitochondrial signaling pathways(e.g.,metabolism,mitochondrial reactive oxygen species,mitochondrial DNA,and the inflammasome)that influence macrophage activation in the innate immune *** particular,we focus on the properties of cochlear macrophages,activated signaling pathways,and the secretion of inflammatory cytokines after acoustic *** hope this review will provide new perspectives and a basis for future research on cochlear inflammation.

Influence of ash composition on the sintering behavior during pressurized combustion and gasification process

To determine the ash characteristics during fluidized bed combustion and gasification purposes, the investigation of the impacts of chemical composition of Jincheng coal ash on the sintering temperature was conducted. A series of experiments on the sintering behavior at 0.5 MPa was performed using the pressurized pressure-drop technique in the combustion and gasification atmospheres. Meanwhile, the mineral transformations of sintered ash pellets were observed using X-ray diffractometer (XRD) analyzer to better understand the experimental results. In addition, quantitative XRD and field emission scanning electron microscope/energy dispersive X-ray spectrometer (FE-SEM/EDS) analyses of ash samples were used for clarifying the detailed ash melting mechanism. These results show that the addition of Fe2O3 can obviously reduce the sintering temperatures under gasification atmospheres, and only affect a little the sintering temperature under combustion atmosphere. This may be due to the presence of iron-bearing minerals, which will react with other ash compositions to produce low-melting-point eutectics. The FE-SEM/EDS analyses of ash samples with Fe2O3 additive show consistent results with the XRD measurements. The CaO and Na2O can reduce the sintering temperatures under both the combustion and gasification atmospheres. This can be also contributed to the formation of low-melting-point eutectics, decreasing the sintering temperature. Moreover, the fluxing minerals, such as magnetite, anhydrite, muscovite, albite and nepheline, contribute mostly to the reduction of the sintering temperature while the feldspar minerals, such as anorthite, gehlenite and sanidine, can react with other minerals to produce low-melting-point eutectics, and thereby reduce the sintering temperatures.

Drought is a major threat to alfalfa(Medicago sativa L.)*** discovery of important alfalfa genes regulating drought response will facilitate breeding for drought-resistant alfalfa ***,we report a genome-wide association study of drought resistance in *** identified and functionally characterized an MYB-like transcription factor gene(MsMYBH),which increases the drought resistance in *** with the wild-types,the biomass and forage quality were enhanced in MsMYBH overexpressed *** RNA-seq,proteomics and chromatin immunoprecipitation analysis showed that MsMYBH can directly bind to the promoters of MsMCP1,MsMCP2,MsPRX1A and MsCARCAB to improve their *** outcomes of such interactions include better water balance,high photosynthetic efficiency and scavenge excess H_(2)O_(2)in response to ***,an E3 ubiquitin ligase(MsWAV3)was found to induce MsMYBH degradation under long-term drought,via the 26S proteasome ***,variable-number tandem repeats in MsMYBH promoter were characterized among a collection of germplasms,and the variation is associated with promoter ***,our findings shed light on the functions of MsMYBH and provide a pivotal gene that could be leveraged for breeding drought-resistant *** discovery also offers new insights into the mechanisms of drought resistance in alfalfa.

Tumor-derived exosomes have been shown to play a key role in organ-specific metastasis,and the androgen receptor regulates prostate cancer(PCa)*** is unclear whether the androgen receptor regulates the recruitment of prostate cancer cells to the bone microenvironment,even bone metastases,through ***,we found that exosomes isolated from PCa cells after knocking down androgen receptor(AR)or enzalutamide treatment can facilitate the migration of prostate cancer cells to *** addition,AR silencing or treatment with the AR antagonist enzalutamide may increase the expression of circular RNA-deoxyhypusine synthase(circ-DHPS)in PCa cells,which can be transported to osteoblasts by ***-DHPS acts as a competitive endogenous RNA(ceRNA)against endogenous miR-214-3p to promote C-C chemokine ligand 5(CCL5)levels in *** the level of CCL5 in osteoblasts could recruit more PCa cells into the bone ***,blocking the circ-DHPS/miR-214-3p/CCL5 signal may decrease exosome-mediated migration of prostate cancer cells to osteoblasts.

Background Diabetes mellitus plays an important role in cancer prevalence and outcomes. The aim of this study was to evaluate the influence of DM on stages and outcomes among patients with colorectal *** The study enrolled 945 patients who were diagnosed as having colorectal carcinoma from August 1994 to December 2002. In the cohort, 26 patients were diagnosed as having DM. With a median follow-up of 45.8 months,differences in overall survival and disease-free survival between the diabetes and non-diabetes groups were *** Kaplan and Meier analysis showed that there were no significant differences between the two groups in overall survival rates at 3 years or 5 years. At 5 years, patients with DM, compared with patients without diabetes, experienced a significantly lower disease-free survival rate （34.2% diabetics vs. 55.1% non-diabetics; P=0.025）.Conclusions DM was associated with an increased risk of recurrence in patients with colorectal cancer.

The Lamiaceae family is renowned for its terpenoid-based medicinal components,but leonurus,which has traditional medicinal uses,stands out for its alkaloid-rich ***,the principal active compound found in leonurus,has demonstrated promising effects in reducing blood lipids and treating ***,the biosynthetic pathway of leonurine remains largely ***,we present the chromosome-level genome sequence assemblies of leonurus japonicus,known for its high leonurine production,and leonurus sibiricus,characterized by very limited leonurine *** integrating genomics,RNA sequencing,metabolomics,and enzyme activity assay data,we constructed the leonurine biosynthesis pathway and identified the arginine decarboxylase(ADC),uridine diphosphate glucosyltransferase(UGT),and serine carboxypeptidase-like(SCPL)acyltransferase enzymes that catalyze key reactions in this *** analyses revealed that the UGT–SCPL gene cluster evolved by gene duplication in the ancestor of leonurus and neofunctionalization of SCPL in ***,which contributed to the accumulation of leonurine specifically in ***,our comprehensive study illuminates leonurine biosynthesis and its evolution in leonurus.
