《民法典侵权责任编解释(一)》第15条将“用工单位劳务关系”和“个体工商户用工关系”纳入《民法典》第1191条第1款规定的“用人单位”替代责任的适用范围,但未能明确网络平台用工替代责任的法律适用规则。《民法典》第1191~第1193条已构建“用人单位劳动关系—个人劳务关系—独立承揽关系”三分法用工关系谱系。应当以第1191条第1款为中心补正用工单位劳务关系替代责任规则的缺失,以第1192条为中心构建个体工商户用工关系替代责任法律适用框架,以第1193条为中心构建网络平台用工替代责任法律适用框架。

The Brief Interactive Optimism Scale (BIOS-G), recently published, was developed to measure optimism based on the interactive personality styles theory in the general population of Mexican adults. It has been validated in both the general population in Mexico and other latin American countries. This study aims to further consolidate the validity of the BIOS-G in a specific population. The objectives are to assess the psychometric properties of its items, validate its unidimensional structure, describe its distribution, verify its internal consistency, and examine its direct relationship with affective balance and positive affect, as well as its inverse relationship with emotional exhaustion and negative affect among Mexican university teachers. The BIOS-G, the CeSQT emotional exhaustion subscale, and Scale of Positive and Negative experience (SPANe) were administered to a non-probability sample of 213 Mexican university teachers. All items demonstrated discriminative power and internal consistency. The scale showed internal consistency (Green-Yang ordinal ω = 0.74 and McDonald ordinal ω = 0.88). The one-factor model presented good to acceptable fit to the data, with an average variance extracted of 0.65. Its distribution was negatively skewed and mesokurtic. The BIOS-G correlated directly with SPANe’s affective balance and positive emotional experiences and inversely with negative emotional experiences and emotional exhaustion, with moderate strengths of association. Its mean score was higher in men than in women and correlated positively with age. It is concluded that the BIOS-G demonstrates internal consistency and validity evidence among Mexican university teachers, and its use in this specific population is recommended.

在第一符号学视角下,符号学意义的电影语言,即是电影意义的符号系统。基于这一论断,本研究以媒介模型为基础,结合规训理论与凝视理论,就影像规训与算法凝视的概念内涵与逻辑模型进行系统界定,构建出一个能够对人机观念对齐问题,进行综合论证的解释框架。其有效揭示了影像符号系统在建构、反馈及评估过程中的运作机制:影像规训通过语境控制符号、符号规训观念及观念调节语境的三重互动,实现符号系统的建构;算法凝视则通过对人类与系统的双重控制形成反馈机制;而观念对齐则作为评估机制,确保了对齐过程的统一性与结果的多样性。这一理论框架为电影语言介入人工智能的认识论范畴与方法论路径奠定了基础,并为人机共生关系中的对齐问题探讨提供了基本的逻辑分析范式。

In this article,we explored the role of adipose tissue,especially mesenteric adipose tissue and creeping fat,and its association with the gut microbiota in the pathophysiology and progression of Crohn’s disease(CD).CD is a form of inflammatory bowel disease characterized by chronic inflammation of the gastrointestinal tract,influenced by genetic predisposition,gut microbiota dysbiosis,and environmental *** microbiota plays a crucial role in modulating immune response and intestinal inflammation and is associated with the onset and progression of ***,visceral adipose tissue,particularly creeping fat,a mesenteric adipose tissue characterized by hypertrophy and fibrosis,has been implicated in CD pathogenesis,inflammation,and *** bacteria from the gut microbiota may translocate into mesenteric adipose tissue,contributing to the formation of creeping fat and influencing CD *** creeping fat may be a protective barrier against bacterial invasion,its expansion can damage adjacent tissues,leading to *** gut microbiota through interventions such as fecal microbiota transplantation,probiotics,and prebiotics has shown potential in managing ***,more research is needed to clarify the mechanisms linking gut dysbiosis,creeping fat,and CD progression and develop targeted therapies for microbiota modulation and fat-related complications in patients with CD.

The recurrence of atrial fibrillation(AF)in patients after successful radiofrequency catheter ablation(RFCA)appears to be an unresolved clinical issue and needs to be clearly *** are many factors associated with AF recurrence,such as duration of AF,male sex,concomitant heart failure,hemodynamic parameters,chronic obstructive pulmonary disease,hypertension,obstructive sleep apnea,hyperthyroidism,smoking and ***,the inflammatory changes are strongly associated with electrical and structural cardiac remodeling,cardiac damage,myocardial fibrotic changes,microvascular dysfunction and altered reparative *** this context,biomarkers reflecting the different stages of AF pathogenesis deserve thorough *** authors of the retrospective study revealed that one-year recurrence rate of non-valvular AF in the high systemic immune inflammation(SII)index group was significantly increased compared to that of the low SII index group and provided additional predictive value to the ***,the authors suggest that this biomarker may help physicians to optimize the selection of AF patients and to develop a personalized treatment *** conclusion,the SII index may serve as a valuable indicator of recurrent AF in patients after RFCA and may be a biomarker with plausible predictive value for poor clinical outcomes.

In this study, we examined variability of sun-related energies, auroral electrojet current, ring current, and magnetopause current during solar cycles 23 and 24. The study revealed a dependence of sun-related energies to the Sun and earth currents systems with solar activity from 1996 to 2019. A decrease in the correlation between sun-related energies and sunspot number was observed over solar cycles 23 and 24 (0.88 for the solar cycle 23 and 0.66 for the solar cycle 24), with a drop in the speed of magnetic disturbances in the solar wind. These results could be attributed to the decrease in Sun’s magnetic field toroidal component magnitude induced by a weak in sunspots number and solar flares during the solar cycle 24. A weak in the earth currents systems (auroral electrojet current, ring current, and magnetopause current) is also observed. During the decrease in the earth currents, several peaks are observed, indicating a nonlinear dependence in the earth currents variation (ring current, auroral electrojet current, and magnetopause current) from solar cycle 23 to solar cycle 24. This could be attributed to the Corotating Interaction Regions (CIRs) observed during the declining phase of solar cycle 23 and the deep minimum preceding solar cycle 24.
