论宪法作为《民法典》的内容渊源——从“合宪性审查”与“利益法学”的正反视角

“依据宪法,制定民法”的具体内涵问题,涉及到“宪法是否为民法的内容渊源”这一极其重要的“宪民关系问题”,并争论至今。采取了正反两条分析进路:从反面推论而言“合宪性审查”角度看,“根据宪法,制定民法”构成对《民法典》进行合宪性审查的前提,反之,如果能够证明可以对《民法典》内容进行合宪性审查,那便意味着宪法与《民法典》之间存在内容连接;从正面推论而言,“利益法学”角度看,《民法典》亦为民事立法者对相互冲突的利益进行评价的产物,而在法治国家的背景下,宪法的规则、原则与精神必然是重要的利益评价标准,从而使宪法与《民法典》之间产生内容连接。虽然在应然层面,根据宪法所制定之《民法典》具有天然合宪性,但也将不可避免地面临现实层面的合宪性危机,而合宪性解释,便是消解此“二律背反困境”的重要途径。

基于换乘时间成本的客流分类及空间分布研究——以厦门市为例

文章基于公交IC刷卡数据,构建收入法模型评估厦门市换乘优惠政策实施后客流换乘的时间成本,与政策规定所减免的费用进行对比,根据乘客的换乘时间评估换乘优惠政策实施后乘客出行的整体效益,将换乘客流划分为换乘零成本客流、换乘额外费用成本客流、换乘额外时间成本客流、换乘额外时间+费用成本客流4类,并从站点、线路、交通小区、OD点密度、通勤与非通勤5方面分析了各类客流的空间分布特征,站点以岳阳小区为中心的区域聚集大量不同类型的客流;线路以24路为主聚集大量不同类型的客流;交通小区以地铁及岛内BRT线路周边的交通小区聚集大量不同类型客流;OD点密度以轨道一号线各站点和BRT各站点作为起点或讫点,聚集大量换乘客流;通勤时各类客流的活动范围较小,跨距较短,跨岛客流相对较少,非通勤时客流呈较明显的跨岛趋势,且跨距普遍较长。文章量化乘客的换乘时间成本以直观反映换乘的实际损耗,为进一步提升公交用户体验,降低乘客出行成本,制定科学有效的换乘优惠政策提供依据。

为探究长宽比、水深和水力负荷对表面流人工湿地水力性能和净化效果的影响及其定量关系,采用e.DC(e.vironme.tal fluid dynamics Code.模型建立表面流人工湿地水动力-水质耦合模型并对模型进行率定和验证,基于构建的模型设置3因素6水平的全因子模拟试验,通过分析216组试验结果研究湿地长宽比、水深和水力负荷及其交互作用对湿地水力性能和净化效果的影响,进而采用多元非线性回归模型将多因子影响与7个评价指标之间建立定量关系。结果表明:长宽比、水深和水力负荷之间的交互作用对水力性能和净化效果均有显著影响(P<0.05)。构建的参数与评价指标的回归模型说明水力效率、有效容积率和莫里尔离散指数与长宽比呈指数相关,总氮浓度去除率与水深呈指数相关,回归方程的建模决定系数均大于0.9,经试验数据验证的相对误差在20%以下,说明模型是可靠的。研究可为表面流人工湿地设计和运行提供依据。

目的探讨丹参酮ⅡA(tanshinone.A, Tan)对卵巢切除(绝经后雌激素缺乏模型)大鼠骨关节退行性变的缓解作用及其机制。方法将8周龄SD雌性大鼠随机分为5组(每组10只):假手术组(Sham),卵巢切除组(OVX)及低、中和高剂量Tan组。双侧卵巢切除术8周后,分别给予大鼠5、10和20 mg/kg Tan治疗28 d。通过X射线、解剖学观察、He.色和甲苯胺蓝染色组织学观察评估大鼠关节软骨情况。免疫组织化学检测软骨组织中转化生长因子β1(transforming growth factor β1, TGF-β1)、磷酸化的Smad2(phosphorylate.-smad2, p-Smad2)、Ⅱ型胶原(type.collage., CⅡ)、基质金属蛋白酶9 (matrix me.alloprote.nase.9, MMP-9)和MMP-13的表达水平。结果 X射线、解剖学观察和组织学检测结果显示,OVX组大鼠膝关节表现为关节间隙狭窄、骨赘形成、软骨侵蚀甚至局部软骨出现裂隙、软骨表面甲苯胺蓝染色变淡,软骨细胞排列紊乱、潮线不清甚至中断,Ke.lgre.-Lawre.ce.级评分、Pe.le.ie.分级评分、Mankin评分和OARSI评分均较Sham组增高(Pe.lgre.-Lawre.ce.级评分、Pe.le.ie.分级评分、Mankin评分和OARSI评分。免疫组化检测显示,相对于OVX组,Tan组软骨组织中TGF-β1、p-Smad2、CⅡ表达增高(P<0.01),MMP-9和MMP-13表达降低(P<0.01),且呈剂量效应。结论 Tan可减轻卵巢去势大鼠关节软骨退变,其作用可能与其调节TGF-β1/Smad2/MMPs信号通路有关。
