知识产权刑事附带民事诉讼制度新探

在知识产权审判“三合一”改革和知识产权检察“四合一”综合履职背景下,知识产权刑事附带民事诉讼制度一体解决刑事追究和民事追责,成为集约化诉讼的现实需求。当前,该制度的适用受到法律、理论和实践上的三重桎梏,影响了该制度司法质效的发挥。知识产权属于民法意义上的“无体物”,其法益侵害属于“财物损失”范畴。在知识产权刑事案件中适用附带民事诉讼符合诉讼的经济合理性和合目的性,是知识产权审判“三合一”改革下的制度创新。推进知识产权刑事附带民事诉讼的适用,应当在厘清“物质损失”概念基础上明确其适用条件,规范其适用方式、完善其证明标准,促进民刑程序相协调,并以全面赔偿为原则准确认定赔偿数额。

Due to the rapid evolution of Advanced Persistent Threats(APTs)attacks,the emergence of new and rare attack samples,and even those never seen before,make it challenging for traditional rule-based detection methods to extract universal rules for effective *** the progress in techniques such as transfer learning and meta-learning,few-shot network attack detection has ***,challenges in few-shot network attack detection arise from the inability of time sequence flow features to adapt to the fixed length input requirement of deep learning,difficulties in capturing rich information from original flow in the case of insufficient samples,and the challenge of high-level abstract *** address these challenges,a few-shot network attack detection based on NFHP(Network Flow Holographic Picture)-RN(ResNet)is ***,leveraging inherent properties of images such as translation invariance,rotation invariance,scale invariance,and illumination invariance,network attack traffic features and contextual relationships are intuitively represented in *** addition,an improved RN network model is employed for high-level abstract feature extraction,ensuring that the extracted high-level abstract features maintain the detailed characteristics of the original traffic behavior,regardless of changes in background ***,a meta-learning model based on the self-attention mechanism is constructed,achieving the detection of novel APT few-shot network attacks through the empirical generalization of high-level abstract feature representations of known-class network attack *** results demonstrate that the proposed method can learn high-level abstract features of network attacks across different traffic detail *** state-of-the-artmethods,it achieves favorable accuracy,precision,recall,and F1 scores for the identification of unknown-class network attacks through cross-validation onmultiple datasets.

The recent increase in blast/bombing incidents all over the world has pushed the development of effective strengthening approaches to enhance the blast resistance of existing civil *** geopolymer composite(EGC)is a promising material featured by eco-friendly,fast-setting and strain-hardening characteristics for emergent strengthening and ***,the fiber optimization for preparing EGC and its protective effect on structural elements under blast scenarios are *** this study,laboratory tests were firstly conducted to evaluate the effects of fiber types on the properties of EGC in terms of workability,dry shrinkage,and mechanical properties in compression,tension and *** experimental results showed that EGC containing PE fiber exhibited suitable workability,acceptable dry shrinkage and superior mechanical properties compared with other types of *** that,a series of field tests were carried out to evaluate the effectiveness of EGC retrofitting layer on the enhancement of blast performance of typical *** tests include autoclaved aerated concrete(AAC)masonry walls subjected to vented gas explosion,reinforced AAC panels subjected to TNT explosion and plain concrete slabs subjected to contact *** was found that EGC could effectively enhance the blast resistance of structural elements in different *** AAC masonry walls and panels,with the existence of EGC,the integrity of specimens could be maintained,and their deflections and damage were significantly *** plain concrete slabs,the EGC overlay could reduce the diameter and depth of the crater and spallation of specimens.

In this paper,distributed model predictive control(DMPC) for island DC micro-grids(MG) with wind/photovoltaic(PV)/battery power is proposed,which coordinates all distributed generations(DG) to stabilize the bus voltage together with the insurance of having computational efficiency under a real-time *** on the feedback of the bus voltage,the deviation of the current is dispatched to each DG according to cost over the prediction ***,to avoid the excessive fluctuation of the battery power,both the discharge-charge switching times and costs are considered in the model predictive control(MPC) optimization problems.A Lyapunov constraint with a time-varying steady-state is designed in each local MPC to guarantee the stabilization of the entire *** voltage stabilization of the MG is achieved by this strategy with the cooperation of *** numeric results of applying the proposed method to a MG of the Shanghai Power Supply Company shows the effectiveness of the distributed economic MPC.

Enhancing oxidation resistance of multicomponent carbides above 2000℃is critical for their thermal protection *** this purpose,novel Nb-and Ta-doped(Hf,Zr,Ti)C multicomponent carbides were designed to improve their oxidation resistance at 2500℃.The results demonstrated that Nb and Ta doping reduced the oxidation rate constant by 16.67%and 25.17%,respectively,thereby significantly improving the oxidation resistance of(Hf,Zr,Ti)*** enhancement was attributed to the changes in oxycarbide composition and distribution within the oxide layer by adding Nb and *** to the different oxidation tendencies of the constituent elements,a distinctive structure was formed in which(Hf,Zr)O_(2)served as a skeleton,and various oxycarbides were dispersed throughout the oxide *** doped Nb and Ta were retained within oxycarbides,retarding the diffusion of oxygen into the *** importantly,the addition of Nb and Ta reduced the size of oxycarbides,decreasing both size and quantity of the pores in the oxide layer and facilitating the formation of a more effective oxygen barrier.

中医五运六气气化理论认为先天气化体质是决定后天疾病发病特征的关键因素。既往研究表明,五运六气气化体质(以下简称体质)特征与多种肿瘤的发生发展密切相关,基于中医五运六气气化理论的肿瘤分型可反映肿瘤人群的预后风险。五运六气气化理论具有较高的应用于指导肿瘤精准医疗策略构建的潜力,然而目前尚未有学者对五运六气气化理论指导肿瘤分子分型与精准医疗策略构建进行研究。为揭示不同体质肿瘤人群的生物学特征差异,筛选适用于各体质人群的潜在抗肿瘤药物,助力构建源自中医原创思维的肿瘤中西医协同精准医疗策略。该研究从UCSC Xena获得了泛癌Bulk RNASeq数据,从英国生物库获得了GWAS队列数据,从eQ TLGen和GTEx V8获得了cis-eQTLs数据。研究基于泛癌Bulk RNASeq,利用机器学习法筛选各体质人群的特征表达基因,利用生物信息学手段探索各体质人群的生物学特征差异,利用孟德尔随机化进行药物靶点筛选,通过分子对接筛选适用于各体质人群的潜在抗肿瘤中药单体,并预测中药单体成药性。结果显示,泛癌队列中不同体质人群在无进展间隔期、生物学功能、免疫细胞丰度、肿瘤药物敏感性、免疫疗法响应程度等方面存在显著差异,提示五运六气气化理论可应用于指导肿瘤分子分型与肿瘤精准医疗策略制定。泛癌队列中不同体质人群的生物学功能特征,一定程度上诠释了五运六气气化理论等中医理论的生物学内涵,并为中医肿瘤临床治疗提供新思路。DMKN等5个特征基因被作为虚拟药物筛选受体,通过分子对接与类药性预测后筛选得到17-beta-estradiol、serotonine、trans-resveratrol、leinoleic acid等潜在抗肿瘤药物。以转录组测序为代表的组学技术将是揭示中医理论科学内涵的有力工具。在各类肿瘤人群中阐释不同体质的多组学特征,是五运六气气化理论应用于肿瘤分子分型与肿瘤精准医疗策略制定的基础。

钛酸锂型锂离子筛(简称钛系锂离子筛)具有吸附容量高、选择性好、寿命长、稳定性高等特点,在盐湖提锂方面具有广阔的应用前景。以二氧化钛与氢氧化锂为原料,通过控制二者的配比和不同高温条件分别固相合成了偏钛酸锂前驱体(β-li_(2)TiO_(3))和正钛酸锂前驱体(li_(4)Ti_(5)O_(12))。研究了这2种锂离子筛活化过程的差异性以及在模拟盐湖卤水的吸附条件下吸附选择性和循环稳定性的差异。结果表明,li_(4)Ti_(5)O_(12)较β-li_(2)TiO_(3)活化条件苛刻,所需酸浓度更高;相同含li+水体中,β-H_(2)TiO_(3)的饱和吸附容量达到32.1 mg/g,而H_(4)Ti_(5)O_(12)的饱和吸附容量仅为5.9 mg/g;2种锂离子筛在离子选择性和循环稳定性方面并无明显差异。
