Relevance of the problem under research is due to the fragmentary character of the regulatory framework for concluding a surrogacy agreement both in Ukraine and foreign countries,which does not solve the full range of problems that arise in law enforcement ***,there is no clear regulation for the notarization of the surrogacy *** study aims to analyze the existing legal regulation of theoretical and practical aspects of the conclusion of a surrogacy agreement and draw certain conclusions and scientific provisions on the notarization of the surrogacy *** leading research methods used for a comprehensive examination of surrogacy and surrogacy agreement were the following:normative semantic method,general logical methods of cognition,comparative and formal legal methods,generalization,historical method,systemic method,and structural and functional *** research results proved the need for the legislative regulation of *** a notarial form of the surrogacy agreement is implemented,it can significantly reduce the criminal component in this service and the risk of adverse consequences for the *** must be a separate law on the regulation of surrogacy adopted in Ukraine,which also concerns all other types of assisted reproductive technologies.

Numerical simulation of triaxial compression test for brittle rock sample using a modified constitutive law considering degradation and dilation behavior

The understanding of the rock deformation and failure process and the development of appropriate constitutive models are the basis for solving problems in rock engineering. In order to investigate progressive failure behavior in brittle rocks, a modified constitutive model was developed which follows the principles of the continuum damage mechanics method. It incorporates non-linear Hoek-Brown failure criterion, confining pressure-dependent strength degradation and volume dilation laws, and is able to represent the nonlinear degradation and dilation behaviors of brittle rocks in the post-failure region. A series of triaxial compression tests were carried out on Eibenstock(Germany) granite samples. Based on a lab data fitting procedure, a consistent parameter set for the modified constitutive model was deduced and implemented into the numerical code FLAC3 D. The good agreement between numerical and laboratory results indicates that the modified constitutive law is well suited to represent the nonlinear mechanical behavior of brittle rock especially in the post-failure region.

在知识产权侵权诉讼中，关于侵权行为及损害金额的证据往往较易灭失且不易收集，需要通过证据保全固定证据资料并强化当事人的事证收集能力。由于性质定位的异化，我国知识产权侵权诉讼中证据保全的运行存在着制度功能单一、要件审查模糊以及两造利益保护失衡等诸多问题。大陆法系采取了实体法与程序法相结合的二维模式以及程序法单行的一维模式两种路径对知识产权侵权诉讼中的证据保全予以规制。证据保全本质上应当属于预先进行的证据调查。从类型化的视角出发，知识产权侵权诉讼中的证据保全制度应区分为证据可能灭失型及确定事物现状型两种。我国立法应当扩充确定事物现状类型的证据保全，明确不同类型证据保全的适用要件，在厘清其证据调查性质的基础上，采取与各类证据方法相适应的具体措施，同时兼顾当事人的程序保障与商业秘密的保护，如此才能充分发挥证据保全制度强化知识产权保护的应有效能。

A new method is proposed to assess the condition of structures under unknown support excitation by simultaneously detecting local damage and identifying the support excitation from several structural dynamic responses. The support excitation acting on a structure is modeled by orthogonal polynomial approximations, and the sensitivities of structural dynamic response with respect to its physical parameters and orthogonal coefficients are derived. The identification equation is based on Taylor＇s first order approximation, and is solved with the damped least-squares method in an iterative procedure. A fifteen-story shear building model and a five-story three-dimensional steel frame structure are studied to validate the proposed method. Numerical simulations with noisy measured accelerations show that the proposed method can accurately detect local damage and identify unknown support excitation from only several responses of the structure. This method provides a new approach for detecting structural damage and updating models with unknown input and incomplete measured output information.

Rapid and accurate identification of potential structural deficiencies is a crucial task in evaluating seismic vulnerability of large building inventories in a region. In the case of multi-story structures, abrupt vertical variations of story stiffness are known to significantly increase the likelihood of collapse during moderate or severe earthquakes. Identifying and retrofitting buildings with such irregularities—generally termed as soft-story buildings—is, therefore, vital in earthquake preparedness and loss mitigation efforts. Soft-story building identification through conventional means is a labor-intensive and time-consuming process. In this study, an automated procedure was devised based on deep learning techniques for identifying soft-story buildings from street-view images at a regional scale. A database containing a large number of building images and a semi-automated image labeling approach that effectively annotates new database entries was developed for developing the deep learning model. Extensive computational experiments were carried out to examine the effectiveness of the proposed procedure, and to gain insights into automated soft-story building identification.

The close coupling of civil litigation rights and human rights mean how well litigation rights are realized can directly or indirectly affect the judicial protection of human ***,human rights protection in the field of civil litigation should take the right of civil litigation as the starting point and *** on a sample questionnaire survey of judges and lawyers,this paper conducts an empirical analysis and proposes that the exercise of this right should be taken as the main line to build a comprehensive protection mechanism for this right to realize its role in providing an institutional guarantee for human rights *** specifies three aspects:first,the process of filing a case should uphold the freedom and equality of the right to initiate litigation,remove substantial obstacles that affect the filing of the case,and ensure access to justice for disadvantaged groups;second,the trial procedure should have strengthened checks and balances on judicial power to ensure the right of litigation is compromised,and respects the procedural subject status of the two parties to realize equal protection of both parties;the third is to promote the implementation and improvement of relief for this right in the supervisory procedure,clarify the boundary of its relief by procuratorial supervision,and enhance the comprehensiveness and accuracy of the relief.

Expertise gains increasing acceptance and importance at trials in ***,the forensic examination quality management system of China has been preliminarily *** are problems,however,for example,laws and regulations related with forensic examination are not comprehensive,forensic institutes pursue their own economic profits excessively and judges sometime have undue blind faith in scientific evidence in *** are hindering forensic examination from being put into full play *** 2005,the Decision of the Standing Committee of the National People's Congress on the Administration ofForensic Examination strengthened the neutrality of forensic *** Criminal procedure law and the civil procedure law revised in 2012 initially set up the expert assistant system,which is expected to break the excessively credulous but unjustified belief in scientific evidence and solve pertinent *** need to focus on the following aspects:First and foremost developing a unified set of rules on forensic examination;secondly,judges need to strengthen their own ability to review scientific evidence and determine its reliability;thirdly,we should actively promote fundamental legal education refonn to remedy the insufficiency of legal understanding of forensic science;and finally,the existing expert assistant system must be further improved to help judges and litigants efiectively to identify and use expertise.
