A Realistic Path to Implementing China's Budget law

The core issue for the implementation of modem budget law is to optimize the satisfaction of society＇s demand for public goods. The form of implementation mechanism that will best achieve this goal has thus become a major topic in the field of legal research. To go beyond the Anglo-Saxon budget model and construct a realistic path for the implementation of China＇s budget law, this issue needs to be explored from the perspective of Chinese citizens in a way that safeguards the fundamental interests of the people and is premised on upholding and improving the People＇s Congress system, so as to achieve a balance between internal and external budget allocation relationships. There are three routes to implementing China＇s budget law： the political, the social, and the judicial. Under the first, citizens＇ political identity interests are represented by deputies who oversee the budgetary powers of administrative bodies through the People＇s Congress. Under the second, citizens individually or collectively participate, influence or even decide the allocation of public economic resources through dialogue, negotiation, reasoning and argument with the responsible budgetary agency in the course of the budget＇s compilation, examination and approval, execution and supervision. Under the third, the establishment of a system for budgetary litigation allows citizens to participate in and supervise the implementation of the budget law, individually or collectively. This provides judicial security for the law＇s implementation. These three realistic implementation routes represent the dialectical unity of concerted institutional effort aimed directly at effective implementation of budget law. Judicial interpretations of budget law implementation indicate the importance and urgency of promoting national governance capacity through reform of the legal systems governing finance and taxation. This explains the significant role of finance and taxation law in national governance.

Optimal investment for the defined-contribution pension with stochastic salary under a CEV model

In this paper, we study the optimal investment strategy of defined-contribution pension with the stochastic salary. The investor is allowed to invest in a risk-free asset and a risky asset whose price process follows a constant elasticity of variance model. The stochastic salary follows a stochastic differential equation, whose instantaneous volatility changes with the risky asset price all the time. The HJB equation associated with the optimal investment problem is established, and the explicit solution of the corresponding optimization problem for the CARA utility function is obtained by applying power transform and variable change technique. Finally, we present a numerical analysis.

Monetary Policy and Borrowers'Loan Defaults:Research Based on Data from Ren re ndai

This paper uses Renrendai data to study the relationship between monetaryj policy and the default behavior of borrowers,and analyzes the transmission *** research shows that tight monetary policy will lead to a significant increase in a borrower s probability to default,and this effect will continue for several *** may be two transmission channels:(i)monetary policy changes a debtor s liquidity through credit and balance sheet channels,which directly affects their current repayment behavior;and(ii)monetary policy may affect a borrower s investment,production and profitability,thus changing their long-term *** paper also finds that the repayment behavior of productive borrowers is more susceptible to monetary policy than consumptive borrowers,and that the default behavior of borrowers in coastal provinces is more susceptible to monetary policy than of borrowers in inland *** findings provide new evidence for understanding how monetary policy affects individual behavior and its transmission mechanisms.

The Effectiveness of Structural Monetary Policy and Macro-Prudential Policies——Based on the DSGE Model That Includes Bank Heterogeneous Credit

Structural monetary policy and macro-prudential policies are important parts of the policy system of the People’s Bank of *** constructing a dynamic stochastic general equilibrium model that includes the heterogeneity of corporate and bank credit,the authors divide the policies of the People’s Bank of China into seven categories,and explores the policy effectiveness of structural monetary policy,macro-prudential policy and traditional aggregate monetary *** simulation of the model,it is found that whether facing technical shocks,interest rate shocks or credit shocks,the structural two-pillar policy tool that uses the deposit reserve interest rate as the target of operation is most conducive to economic *** progress has the most positive and lasting impact on *** rates and credit policies will leave follow-up problems in the adjustment of the economy,and structural two-pillar policies can alleviate the impact of these problems.

The Roles Played by the Staff and Workers' Representative Congress in the Formation of Work Regulations

Article 4 of the Labor Contract law lays down the right of the Staff and Workers＇ Representative Congress （SWRC） to deliberate on the formulation of （intra-enterprise） work regulations, but this has become a ＂soft＂ law in judicial practice. The judicial criteria for judging the validity of work regulations are in essence determined by the judge＇s judgment on their reasonableness. As an important embodiment of Chinese politics, economics and culture, the transformation of the SWRC that accompanied the market economy has not negated its value as an indigenous traditional resource. The SWRC does not just enjoy deliberative rights in the formation of regulations, as clearly specified in constitutional law, but also has rights under the law in local legislation and practice. Hence the system of work regulations is neither a unilateral decision on the part of management nor a contract, but rather an autonomous norm developed through the SWRC mechanism. Given the mandatory nature of Article 4 of the Labor Contract law, regulations will only be valid after they havegone through a democratic process. The further development of the theory of normative system formation should endow the SWRC with greater rights and integrate it smoothly with the collective contract system to standardize collective labor relations.

The Stagnant Export Upgrading in Northeast China:Evidence from Value-added Tax Reform

China's 2004 value-added tax(VAT)pilot reform in the Northeast region,which changed the VAT from production type to consumption type,introduced a sizable tax credit for fixed investment in manufacturing industries,leading to more investment and higher productivity at firm *** paper,however,uses difference-in-difference estimation and finds a negative structural effect;that is,the VAT pilot reform leads to a reduction in the export sophistication of Northeast cities relative to other cities in China,and the results hold for a battery of robustness *** is found that resources are reallocated towards less-sophisticated *** the products with higher export sophistication are more skill and research and development(R&D)intensive,the shortfalls of skilled labor and R&D spending hinder the upgrading *** a new round of revitalization plans in the Northeast,policymakers should be cautious with similar structural effects and focus on increasing skilled labor supply and R&D investment.

Impact of Electricity Shortages on Productivity: Evidence from Manufacturing Industries

Electricity shortages present a significant constraint on manufacturers,who rely on electricity as an important input into *** China,electricity supply has been growing ***,the rapid industrialization sometimes makes the power supply still unable to meet the *** a survey of 1673 Chinese manufacturing firms,this paper explores how firms response to electricity shortages and its impact on *** find that self-generation of electricity and investment in Research and Development(R&D)have significant positive relationships with electricity *** investigations reveal that self-generation is the most common way to deal with electricity ***,it aggravates productivity *** investment in Research and Development can promote productivity,it cannot offset the negative impact of electricity shortages on *** on subsamples show heterogeneity in the impacts of electricity shortages across *** particular,large firms are more inclined to invest in R&D than small and medium-sized firms *** are also the one who suffer significant productivity loss due to self-generation of *** it is possible for medium-sized firms to reduce productivity loss through R&D,they are not likely to invest in R&D as a response to electricity *** study illustrates that firms can hardly have effective solutions to electricity shortages,and policy makers should take great efforts to increase electricity supply.

＂Engaged Buddhism＂ Oriented Buddhism Charity and Philanthropy Analyzing of Three Buddhism- related NPOs in Nanjing

Religious people have participated in social service for a long time,and the spreading of the theory of "Engaged Buddhism"provides Charity work with much legitimacy among religious people. This paper uses three Buddhist NPO s as cases: "Classics Reading Class","H ui Ji Temple Charity ",and "H ome of Friends of Buddhism",tries to find what are the supporting theory of the three NPO s,howdo they motivate charity funds and volunteers,their activities,and their relationship with government. We find,the three NPO s use "Engaged Buddhism"as their leading theory,and they use charity and philanthropy to stimulate participants to serve people and society,combining belief with practice. Besides,in current circumstance,we also notice that the NPO s showthe characters of making a comprise with government and secular society.

Information Competency and Pressure-induced Legislation

Pressure-induced legislation occasioned by media discourse is actually the result of an information deficit on the part of legislators. If legislators＇ information competency fails to meet the knowledge challenges of the modem legal system and its activities, they will be powerless to resist the infiltration of media discourse. The result is that legislative activities are inextricably intertwined with the media; once a particular social issue is catapulted on to the media agenda, legislators have no choice but to fall into line, creating the phenomenon of pressure-induced legislation. The essential characteristic of law is its inherent constancy and stability, whereas pressure-induced legislation often loses the calmness, objectivity, prudence and comprehensiveness proper to law. Such legislative decision-making runs counter to the inherently rational mechanism of legislation and produces unfair and ineffective redistributive results. Pressure-induced legislation highlights the importance of information in public policy choices and institution design. It would be desirable for the whole legal system aimed at evaluating legislative performance to be introduced so as to provide legislators with a sufficient incentive to remodel their information competency and ensure the scientific nature and rationality of legislation.

Food safety regulatory systems in Europe and China:A study of how co-regulation can improve regulatory effectiveness

Food safety has received a great deal of attention in both developed and developing countries in recent years. In China, the numerous food scandals and scares that have struck over the past decade have spurred significant food safety regulatory reform, which has been increasingly oriented towards the public-private partnership model adopted by the Europe Union＇s （EU） food safety regulatory system. This paper analyzes the development of both the EU＇s and China＇s food safety regu- latory systems, identifies the current challenges for China and additionally considers the role of public-private partnership. The success of co-regulation in the food regulatory system would bring significant benefits and opportunities for China. Finally, this paper recommends additional measures like training and grants to improve the private＇s sector effectiveness in co-regulating China＇s food safety issues.
