新型网络犯罪具有不同于传统犯罪的“积量构罪”特征,刑法相关规定的适用遇到困难,按照实质预备犯、帮助犯相关理论解释难以实现理论自洽。新型网络犯罪立法是回应网络犯罪新变化的正当性立法,利用信息网络实施的特殊犯罪方法和限定犯罪危害量的情节要件是其满足刑事违法性和刑罚可罚性条件的关键。新型网络犯罪行为的危害性不大,情节要件弹性大,相关司法适用标准不明确,导致适用率低并出现犯罪圈的不当扩张。为了充分发挥新型网络犯罪立法的功效,应根据其特殊的罪行构造制定合理的司法规则,对其构成要件要素合理缩限和对情节要件类型化限定化解释。

近年来,许多研究开始探讨信息技术的应用在促进政府廉政方面的作用,并且指出信息通信技术将提高政府的清廉程度。但是已有的研究较多关注两个因素的相关性,很少有研究深入细致地分析信息和沟通技术到底通过什么样的关键机制来促进政府的廉政建设。本研究通过对中国两项地方廉政创新改革的案例分析发现,其中的关键机制在于提高信息的可获得性。具体来说包括两个相互关联的机制:降低纵向政府层级间的信息不对称程度,以及穿透横向政府部门间的信息壁垒。

在现代社会,身处不同阶层的女性家长都卷入以教育参与建构母亲身份的过程中。但是不同阶层的母亲却有不同的行动方式。在日益激烈的教育竞争中,普通劳动家庭的母亲迁居学校附近,照料面临高考的子女,并在陪读劳动中建构其“陪读母亲”身份。本研究以典型的高考陪读群落聚居地M镇的陪读母亲为研究对象,从性别和阶层视角结构化地分析“陪读母亲”的教育劳动及生产关系特征。“陪读母亲”的教育劳动是家庭性别分工下新的“家务劳动”。从分工内容看,母亲们的服侍子女生活的陪读劳动属于学校教育劳动分工链溢出的“低端”劳作。一方面,由于缺乏文化资本,家长与学校的关系是“陪”与“服从”,另一方面,她们自觉远离“素质教育”,与学校有效的“应试教育”形成有机配合;传统“望子成龙”和现代“儿童本位”养育观联合塑造了陪读母亲配合学校教育的服务型母亲形象。陪读,既是在当前教育与社会劳动分工下中下层女性家长不得不以“照料子女生活”的方式参与的教育劳动,又是中国劳动阶层母亲为争取子女教育成功所做出的能动的、理性的行动策略。

Catchwords,as important social and cultural symbols,are the barometer of a country's society and culture.In China,various catchwords are coined and used every year by Chinese people,especially the young.Of these catchwords,one particular type that expresses despondency or Sangness is increasingly gaining scholarly attention.This study takes a socio-linguistic approach to investigating the most frequently used Sangness-related Chinese catchwords in the past ten years.By examining the annual top ten catchwords selected by Biting Words and Chewing Words between 2013 and 2022,it finds that the most frequently used Sangness-related Chinese catchwords in the past decade have been(1)Ge You Slouch,(2)feeling awful and wanting to cry,(3)Buddha-like,(4)996 work schedule,(5)life is too hard for me,(6)laborer,(7)involution,(8)lying flat,and(9)mental internal friction.These catchwords mainly serve the functions of deconstructing mainstream values,expressing self-mockery,and seeking value recognition.The development of these Sangness-related catchwords is characterized by an increasing diversity and a strongerapplicability.

Chinese science fiction (sf) writer Liu Cixin (b. 1963) has constantly been dubbed as China’s Arthur C. Clarke (1917-2008) ever since he won the 2015 Hugo Award for best novel. He himself humbly states on several occasions that everything he writes is just clumsy imitations of Arthur C. Clarke. One similarity between Liu and Clarke is the obsession with the imagination of the alien encounter. But their imagination of the alien other has one major difference: While the aliens in Clarke’s sf are mostly benevolent, those in Liu’s are mostly malevolent. This essay compares the differences between their alien encounter sf, focusing on Childhood’s End and The Three-Body Trilogy (Santi sanbuqu). I will especially look at how the narrative point of view and the consequence of the alien encounter differ in the two texts. And I argue that Childhood’s End is an unapologetic justification of (British) colonialism (dressed up as the benevolent Overlords) and propaganda for colonial logics, whereas Liu’s trilogy is a representation of the colonial encounter story written from the point of view of the (semi-) colonized, for whom this experience is characterized by dehumanization. The Three-Body Trilogy could be considered as resulted from the revival of the national humiliation discourse in the 1990s.

Throughput Servicing Time Allocation of Hybrid Storage System Based on Client Grouping Mechanism

The fair division theory has emerged as a promising approach for the throughput allocation of hybrid storage system. While most of them cause the unfair allocation of the throughput servicing time due to taking no consideration of clients’ request IO latencies. We propose one Servicing time allocation method based on the client grouping mechanism(STCG), STCG establishes fair allocation policies based on clients’ workload weights,which can achieve a fair throughput servicing time allocation, and can maximize the resource utilization. The experimental result shows that STCG’s allocation enjoys fair properties in each client group, and compared with the method proposd recently, STCG can improve the resource utilization about 12%–330%.

Learning-based multi-task models have been widely used in various scene understanding tasks,and complement each other,i.e.,they allow us to consider prior semantic information to better infer depth.We boost the unsupervised monocular depth estimation using semantic segmentation as an auxiliary task.To address the lack of cross-domain datasets and catastrophic forgetting problems encountered in multi-task training,we utilize existing methodology to obtain redundant segmentation maps to build our cross-domain dataset,which not only provides a new way to conduct multi-task training,but also helps us to evaluate results compared with those of other algorithms.In addition,in order to comprehensively use the extracted features of the two tasks in the early perception stage,we use a strategy of sharing weights in the network to fuse cross-domain features,and introduce a novel multi-task loss function to further smooth the depth values.Extensive experiments on KITTI and Cityscapes datasets show that our method has achieved state-of-the-art performance in the depth estimation task,as well improved semantic segmentation.
