“ICC arbitration in Shanghai" held valid by Chinese Supreme Court: does China open door for non-PRC arbitration commissions?

Background: In mid-2022, a global mpox (formerly 'monkeypox') outbreak affecting predominantly gay and bisexual men emerged in non-endemic countries. Australia had never previously recorded mpox cases and there was no prior research on knowledge or attitudes to mpox among gay and bisexual men across Australia. Methods: We conducted a national, online cross-sectional survey between August 2022 and September 2022. Participants were recruited through community organisation promotions, online advertising, and direct email invitations. Eligible participants were gay, bisexual or queer; identified as male (cisgender or transgender) or non-binary; aged 16 years or older; and lived in Australia. The main outcome measures were: knowledge and concern about mpox; recognition of mpox symptoms and transmission routes; vaccination history; acceptability of behavioural changes to reduce mpox risk, and willingness to be vaccinated. Results: Of 2287 participants, most participants were male (2189/2287; 95.7%) and gay (1894/2287; 82.8%). Nearly all had heard about mpox (2255/2287; 98.6%), and the majority were concerned about acquiring it (1461/2287; 64.4%). Most of the 2268 participants not previously diagnosed with mpox correctly identified skin lesions (2087; 92%), rash (1977; 87.2%), and fever (1647; 72.6%) as potential symptoms, and prolonged and brief skin-To-skin contact as potential ways to acquire mpox (2124, 93.7%; and 1860, 82%, respectively). The most acceptable behavioural changes were reducing or avoiding attendance at sex parties (1494; 65.9%) and sex-on-premises venues (1503; 66.4%), and having fewer sexual partners (1466; 64.6%). Most unvaccinated and undiagnosed participants were willing to be vaccinated (1457/1733; 84.1%). Conclusions: People at risk of mpox should be supported to adopt acceptable risk reduction strategies during outbreaks and to seek vaccination. © 2023 CSIRO. All rights reserved.

this paper firstly gives summary introduction of the landmark decision of Chinese Supreme Court in Longlide case, which holds "ICC arbitration in Shanghai " as valid. For purpose of proper interpretation of this decision, this paper then analyzes Chinese law’s special requirement regarding " selected arbitration commission " in arbitration clauses, special " choice of law " rule regarding law applicable for determination of validity of arbitration clause, and case analysis regarding Chinese court judicial practice regarding ICC arbitration clause prior to Longlide case. After detailed analysis of WTO Rules regarding trade in service, this paper concludes that for purpose of China’s WTO commitment, arbitration service is not within scope as opened to other WTO members. Coupled with analysis of Chinese Supreme Court’s decision in the Marinic case regarding practical impediments of non-PRC arbitration commissions’ arbitration in China, this paper concludes that although "ICC arbitration in Shanghai" is validated, there is still a long way to go before non-PRC arbitration commissions can arbitrate effectively in same manner as China’s domestic commissions in China.

如果精神病是一种跨诊断的维度,精神病性症状的出现受动态变化的情境和情感因素左右,而后者又是可治疗的,那么目前精神科疾病的分类学和治疗研究的方法可能需要修改。迄今为此,无论在临床工作上还是在疾病概念上,占主导地位的方法是将精神病性症状置于精神分裂症的框架中。然而,终生患病率为1%的精神分裂症只代表了部分预后不佳的精神病谱系障碍,而后者发生更多,终生患病率为3.5%。因此,精神分裂症的研究结果可能反映了预后相关的机制,而非精神病和其他症状维度之间本质上的相关性。同样,常见的非精神病性精神障碍中高达30%的个体有阈下精神病性症状,他们会被归于精神病的跨诊断维度之下,这些精神症状还会影响临床严重程度和治疗有效性。上述发现也同样提示武断区分"精神病性"与"非精神病性"的做法妨碍了临床实践和研究。精神病学诊断手册可以借鉴跨诊断维度(包括精神病的跨诊断维度)的体系。引入跨诊断维度,则既能根据原则进行分类诊断(即疾病分组的特异性),又可结合个体特有的多维度综合评分(即个体特异性)。这样的益处在于促使人们思考在精神病理学中症状之间是如何动态地交互作用的,并思考社会环境是如何影响精神病理症状的。

Background With some 134,073,166 people living in endemic communities at risk of infection[1],Nigeria is the most endemic country in Africa and requires preventive chemotherapy(PC)for a total of 26.3 million persons[2].The National Schistosomiasis Elimination Programme(NSCHEP),with the support of international partners,has been implementing PC in Nigeria since 2009 and most recently will need to revise its current strategy(Additional file 1).For example,the new World health Organization(WHO)guideline has six key recommendations that will dramatically change the implementation of schistosomiasis elimination in endemic countries[3].However,its impact and programmatic implications will vary from country to country,hence the need for a country-specific analysis.

The impact of South-South cooperation(SSC)has been bolstered in the context of implementing the International Conference on Population and Development(ICPD)Programme of *** the past 25 years since ICPD in 1994,remarkable progress and achievements have been made in promoting SSC in population and *** has been committed to working with developing countries,UN agen-cies and international organizations to advance ICPD under the framework of *** the landscape of international development assistance has been changing and the ICPD remains as an unfinished agenda,the SSC has increasingly recognized the importance of effective financial inclusion policy in the implementation of the ICPD and the 2030 Agenda for Sustainable *** international community has recently identified seven strategic priority areas for SSC in the next few years,i.e.,(1)population dynamics and development;(2)universal access to reproduc-tive health and family planning services;(3)women’s,children’s and adolescents’health;(4)healthy ageing;(5)migration;(6)health and poverty alleviation;and(7)ending sexual and gender-based *** institutionalization and operation-alization remain as critical challenges,and special attention needs to be given to address these *** political commitments,enhanced capacity building,better coordination and partnerships establishment of the SSC Center of Excellence,adequate resource mobilization and more evidence-based researches and systematic evaluation are recommended as future strategies for further promoting the SSC in population and development.

AIM:To compare program costs of chronic hepatitis B(CHB) screening and treatment using Australian and other published CHB treatment ***:Economic modeling demonstrated that in Australia a strategy of hepatocellular cancer(HCC) prevention in patients with CHB is more cost-effective than current standard care,or HCC *** upon this model,we developed the B positive program to optimize CHB management of Australians born in countries of high CHB *** estimated CHB program costs using the B positive program algorithm and compared them to estimated costs of using the CHB treatment guidelines published by the AsianPacific,American and European Associations for the Study of Liver Disease(APASL,AASLD,EASL) and those suggested by an independent United States hepatology *** used a Markov model that factored in the costs of CHB screening and treatment,individualized by viral load and alanine aminotransferase levels,and calculated the relative costs of program *** were discounted by 5% and calculated in Australian dollars(AUD).RESULTS:Using the B positive algorithm,total program costs amount to 13 979 224 AUD,or 9634 AUD per *** least costly strategy is based upon using the AASLD guidelines,which would cost 34% less than our B positive *** the EASL and the United States Expert Group guidelines would increase program costs by 46%.The largest expenditure relates to the cost of drug treatment(66.9% of total program costs).The contribution of CHB surveillance(20.2%) and HCC screening and surveillance(6.6%) is small-and together they represent only approximately a quarter of the total program ***:The significant cost variations in CHB screening and treatment using different guidelines are relevant for clinicians and policy makers involved in designing population-based disease control programs.
