Xi Jinping’s discourses on respecting and protect-ing human rights stand as a shining example of the sinicization and modernization of Marxist human rights theory,embodying profound theoretical,political,practical,and cultural *** research has conducted comprehensive and systematic theoretical analysis and academic extractions on the following contents:the core essence in-herent in these important discourses,including the“theory of human rights concepts,”the“theory of human rights paths,”the“theory of human rights practices,”the“theory of human rights protection,”and the“theory of human rights governance,”along with their profound theoretical significance,practical significance,and global *** the future,researchers should emphasize efforts on studying the original texts and understanding the original *** focusing on the precision of concepts,the scientific nature of the prop-ositions,the maturity of theoretical systems,and the rigor of internal logic related to Xi Jinping’s discourses on respecting and protecting human rights,researchers should also pay attention to constructing a discourse system on human rights from the dimensions of discourse power,discourse cluster,and discourse *** should be adept at drawing innovative insights into human rights theory from China’s vibrant human rights practices and the vast masses of *** approach will facilitate the systematic unfolding,academic trans-formation,and innovative development of Xi Jinping’s discourses on respecting and protecting human rights.

In 2023, China's human rights research is aimed at addressing “China's question,” the “world's question,” the “people's question,” and the “question of the times.” Resolving “China's question” on human rights seeks to establish the subjectivity of the Chinese path of human rights development. The ontological interpretation of the Chinese path of human rights development has elucidated the historical, theoretical, and practical logic of its formation, while the epistemological exploration has unfolded the subject presuppositions,theoretical compositions, and reference systems of the Chinese path of human rights. Addressing the “world's question” of human rights aims to answer how the world has changed in the field of human rights and what China should do in response. Faced with the severe challenges of global human rights governance, relevant studies have proposed “Chinese solutions” from the perspectives of overall strategy, historical experience, value guidance, and institutionalized participation, among others. Responding to the “people's question” regarding human rights means continuously meeting the growing demands of the people for a better life. Relevant studies focus on explaining the relationship between fundamental human rights and maximum human rights, the relationship between inclusive human rights and specific group interests,and the relationship between constitutional and legal guarantees of human rights. Seeking answers to the “question of the times” concerning human rights involves adapting to the changing times and meeting the needs of the times on human rights. Relevant research focuses on new demands in the field of human rights, particularly discussing digital human rights, environmental human rights, climate and human rights, as well as business and human rights. Despite almost halving the proportion of the world＇s undernourished over the past two and half decades, the number of undernourished people in the world remains staggeringly high. Efforts to address the global state of food insecurity must target China and India, which are home to the world＇s highest and second highest number of undernourished people. This article analyzes the comparative experiences of tackling food security in China and India and adopts an inter-disciplinary approach, which melds legal, economic, and human perspectives to food security. Both China and India have made concerted efforts to improve food security of vulnerable populations in the past three decades. These efforts have historically focused on actively promoting grain production, which has been largely successful in achieving grain self-sufficiency and securing adequate availability of food for their populations. However, the contemporary challenges to food security are now increasingly driven by unsustainable dietary patterns and are exacerbated by growing populations, increasing wealth, and the globalization of food supply chains. As a result, the cause of food insecurity is no longer fundamentally about food supply, but rather about the extent to which marginalized populations are empowered with the rights, freedoms, and capabilities that enable them to attain healthy and productive lives. China and India apply markedly different approaches to address the issue of people＇s access to food. In India, the right to food movement has gained momentum through the work of civil society actors and there is now a legal right to food. In contrast, in China the right to food is neither stipulated in Chinese law nor referenced to in the official policy rhetoric as the country seeks to ensure access to food by focusing on poverty alleviation more generally through an income transfer program and a non-food based, social safety net to help the poor. 本文探讨可能有助于克服国际贸易与环境条约间冲突的法律方法。传统上,系统整合原则一直是将国际法视为一个整体概念的工具,也是避免国际条约间冲突的可行手段。然而,系统整合原则仅适用于国际裁决层面。这使现有文献在避免条约冲突的需要与系统整合原则仅能发挥的有限作用间留下了一个空白。在分析相关资料的基础上,本文探讨系统整合原则所蕴含的基础原则,包括相互支持原则、善意原则、合作原则和协调原则。本文认为,这些基础原则不仅能在国际裁决层面,而且能在国际组织和国内层面有助于预防条约冲突、促进条约间的和谐。因此,国际贸易与环境条约冲突预防机制应当既包括系统整合原则,又包括其蕴含的基础原则,从而在国际裁决、国际组织和国内三个层面有效避免实践中的条约冲突。

Since 2007 when Regulations on Government Information Disclosure was adopted, the State Council has issued almost a dozen documents to guide government information disclosure around the country. These documents have gradually expanded the scope of disclosure and recognized the significant role of transparency in promoting the rights to information, participation and supervision, and in building a government that is innovative, impartial and operating under the law. Meanwhile, these documents have, in both theory and practice, exceeded the limit of the Regulations, posing a challenge to increasing government transparency proposed at the Third Plenary Session of the Eighteenth CPC Central Committee.

The Regulation on the Education of Persons with Disabilities, which came into effect in 2017, stipulates for the first time disabled children’s right to individualized education, clarifies the subjects who determine and influence the individualized education that disabled children receive, and determines the procedures for disabled children to receive individualized education. However, compared to the subjects that determine disabled children’s right to individualized education and procedural provisions as stipulated in the U.S. laws such as the Individuals with Disabilities Education Act of 1990, the Regulation on the Education of Persons with Disabilities in China has some problems, including inadequate participation of disabled children and their parents and incomplete relief settlement mechanism. China should further improve the legal provisions relating to disabled children’s right to individualized education, and safeguard the right of participation and the right to relief of disabled children and their parents.

Countries in the world lack the ability to maintain internal independence and to cope with new external risks, sov ereign state relations based on respect for diversity are giving way to global solidarity. The concept of a community with a shared future for all mankind emphasizes relative independence along with the integration of human society and the joint liability of states. The basic principle is to recognize and respect diversity so as to maintain and enhance integration. In the discourse of a community with a shared future, we must look at human rights and the promotion and protection of human rights from a relational and symbiotic perspective. The concept of human rights is comprehensive, the universality of human rights does not mean the universality of human rights standards, and the global governance of human rights needs to strengthen both the internal c and external capacities and conditions of countries. In this regard, China’s experience is to form a task-oriented target governance model, enhance the enforceability and evaluability of the legal protection of human rights, substantiate and operationalize human rights principles and proposals at all levels through efforts such as establishing mechanisms and initiating forums, and continue to implement and enhance the external cooperation mechanism. The vulnerability, diversity, and scarcity of individuals and human societies are the roots of the problems of global peace and security, and a community with a shared future is also a community of rights, obligations and responsibilities. Therefore, the promotion and protection of human rights is not a burden to be distributed, but a responsibility to be shared, a collective responsibility based on shared values.
