The digital economy can significantly deepen supply-side reform and upgrade consumption and lifestyle in the new *** having made great achievements,the digital economy has also introduced many regulatory risks and *** basic logic of the digital economy is the eco-industrial chain based on data and big data *** the current data property rights system is unclear,various forms of competition based on data resources have seriously challenged existing laws and their implementation *** address the problems of an insufficient institutional supply and weak implementation,and to facilitate the growth of the digital economy,we should update the regulations’concepts and methods,establish a new logic of system regulations,improve the implementation mechanisms by using the overall and multi-level regulation thinking,and build a multi-dimensional,diversified and all-round economic rule of law regulation system led by the government with the participation of operators,consumers and social *** regulation system relies on the synergy between top-level design and top-level promotion,respects the balance of multiple interests,and finally realizes the three-dimensional integration of efficiency,fairness and security.

The establishment of the right to resistance in the constitutions in western countries has its constitutional background and the original intention of granting the right to the citizens to restore the constitutional order so as to prevent the tyranny. It is itself an integral part of the order of the rule of law. However, the establishment of this right itself is not guaranteed by the relevant legal systems. Even in the countries ruled by laws that stipulate the right to resistance of the citizens, the system is a quite threatening ＂double-edged sword＂ to the order of the rule of law. If it cannot be well regulated, it will even destroy the rule of law. There^bre, the right to resistance of the citizens has its positive significance to the construction of the rule of law, but its negative significance is inevitable. Especially in the environment of today＇s China, we should be more cautious to fit the right to resistance into our constitution.

the rule of law has international as well as domestic attributes, so it can be divided into two levels： the domestic rule of law and the international rule of law. Using the thinking behind the international rule of law to build the rule of law in China is both necessary and inevitable. China should put into practice the idea of the international rule of law at the institutional and the governance levels, and should at the same time participate in the UN＇s rule of law activities and in international rule-making, thereby extending its rule of law discourse power and influence in the international sphere.

People with mental disorders are a special group that are at high risk of living in poverty China’s legal system concerning mental health is far from adequate in both theoretical and practical aspects,such as legislative concepts,institutional structure,legal norms,and targeted poverty reduction through health care The improvement of China’s legal system concerning mental health needs to focus on protecting the rights and interests of people with mental disorders and take the following measures,including the precise poverty control for people with mental disorders,addressing comprehensive empowerment,and strengthening the subjective status of people with mental disorders,promoting the"community based"model of mental health governance based on social return,improving the financing mechanism and making use of the advantages of local governance.

As a system that is symbolic of contemporary China,the politicallegal system refers to the governance structure that under the leadership of the Communist Party of China(CPC),law-enforcement and judicial agencies and various governance subjects jointly promote a peaceful China initiative and build a China under the rule of *** historical evolution from the classical rites-law tradition to the modern political-legal system reflects the consistent political focus and ideological exploration of China’s politicians and thinkers about the national rise and *** basic structure of the political-legal system can be divided into three principal groups of relationships,namely,the relationships between various law-enforcement and judicial agencies,the relationships between law-enforcement and judicial agencies and external bodies,and the relationships between the CPC and law-enforcement and judicial *** normative principles concerning these three principal groups of relationships constitute the basic rules for the institutional design and practical operation of the political-legal *** normative principles of the first group of relationships relate to self-integration,division of responsibilities,mutual cooperation and mutual *** normative principles of the second group of relationships involve prioritizing social autonomy,primary-level governance and front-end *** normative principles of the third group of relationships are concerned with macro-leadership,centralized leadership and leadership under the rule of *** analysis of these three sets of normative principles shows that China’s political-legal system not only follows the universal law and common mechanism of modern national governance,but also accumulates the local experience and unique wisdom of China’s governance.

伦理豁免纵贯中华伦理、中华法系，横通“作证豁免权”等现代法律制度，会通伦理和法律关系、民族精神和时代精神，渊源深、土壤厚、生命力强。因此在功能意义上，它从消极防御、积极建设两方面直接敦睦伦理，最终从根本上调谐社会秩序，为法治中国培育积极因子。对每个人及其家庭而言，伦理豁免是有权敦睦伦理的优先权，是人道而公道的；在民间，伦理豁免经由家族自治、乡村绅士自治、行业自治等一步步发育出基层自治，由内而外、自下而上培育法治生长点；在制度上，伦理豁免适度限制公权力，保护伦理权，保障伦理圆满和绵延，在家和国、伦理和政治法律之间确定边界，防止国对家的挤压甚至侵犯，防止法律、政治等公权力对伦理私权利的不当介入和非法侵害。

China＇s Thirty Years of Reform and Its Future Road to a Rechtsstaat

Along with the deepening of China＇s marketization-oriented reform, the widespread corruption of government officials and whether or not the fast economic growth in the last 30 years in China is sustainable have become the two serious problems disturbing the Chinese government and people of all circles in China. This paper argues that something must be done in the construction of China＇s legal system and in its constitutional reform, otherwise the problems of prevalence of corruption will eventually hold back the high economic growth of China. Starting from the discussion of the differentiation of two concepts of ＂the rule by law＂ and ＂the rule of law,＂ this paper suggests that laws in China should be restored to their natural role as the incarnation of justice on the basis of jurisprudence reasoning, and instrumentalism, pragmatism and utilitarianism in China＇s current legal theory inherited from the traditional Chinese culture should be discarded. Otherwise, it will be impossible to restore the sacredness and authority of law in China, and then it will take an unconscionable time to reach the state of ＂the rule of law＂ with constitutional democracy in China and there will be no way to tackle the problem of institutionalized corruption in the contemporary Chinese society once and for all.
