intellectual property rights securitization(IPRS) is a fundamental approach to monetizing intellectual property rights to resolve financing difficulties for scientific and technological enterprises. It is also a necessary way to realize the value of intellectual property rights. Existing researches in China only introduce foreign IPRS models but rarely discusses reasons behind the IPRS successes and lessons drawn from its failures. There are also rare IPRS policy researches and recommendations for IPRS development in China. This article cards the IPRS policies in China first, and then conducts a comparison research of intellectual property rights owners, obligees, originators, credit rating agencies, issuing scale, and so on as main information and data from the IPRS cases at home and abroad. Furthermore, this article constructs a three-dimensional policy model of “subject-element-process” and identifies the main problems from the laws and policies, operational models, valuation methods, investment objectives, tax and service rates,etc. of the IPRS. The results indicate that the model we construct is suitable for the Chinese market in that it describes the objectives and processes of IPRS as well as specific activities and capital flows. In the end, this article puts forward five policy recommendations for China’s IPRS development. The first is to add the intellectual property rights future implementation cash flow as the IPRS object. The second is to improve the existing evaluation methods. The third is to combine SPT and SPE models, establish in-house intellectual property rights service teams of security companies, set up government risk fund pools to lead IPRS, and reduce the investment threshold. The viability of exponentially growing non-fungible token(NFT)market is evaluated by identifying potential value-generating mechanisms that can be *** identifying the value-generating mechanisms underlying the positive values of NFTs,this study establishes a pricing model for NFTs that follows a continuous-time financial *** NFTs are claimed to securitize“ownership rights short of use”,and as such they may potentially serve as a substitute for the need to rely replace the reliance on the legal protection provided by intellectual property rights(IPRs).Considering this issue,this study evaluates the likelihood that NFTs will replace existing mechanisms that protect producers’rightful claim to use their assets or the need to apply the legal code that governs *** financial condition for this potential shift is derived for a category of assets whose use or consumption does not reduce supply as the notion of scarcity does not apply.

The focus of this research is in the area of intellectual property rights (IPR) protection which has been a continuing concern by most member countries of WTO. The central issue is whether to adopt a strong or weak IPRs protection. Developed countries tend to use various types of pressure to induce developing countries to enforce IPRs law strictly. On the other hand, the Trade-Related Aspects of intellectual property rights (TRIPS) appears to require a minimum standard for IPRs protection by its desire for IPRs to contribute to the promotion of technology transfer. Developed and developing countries, and particularly, those with a growing technological capacity, expect foreign technology transfer to increase when strengthening their intellectual property protection (IPR) rights. However, some developed and developing countries are reluctant to follow the requirement of TRIPS because of their perception that IPRs protection has scarcely brought those benefits or that they suffer from it. These concerns serve as the rationale for the general purpose of this study, which is to investigate the stronger impact of IPRs protection on technology transfer and R&D spillover in developed and developing countries. The objectives of this study are:first, to investigate the impact of IPR protection on technology transfer in both selected developed and developing countries;second, to investigate the role of R&D spillover in transferring *** study uses panel data from30countries during2000-2011with fixed effect and random effect models. The level of technology transfer is measured by the impact of IPRs protection variable on the productivity growth of a country. This study uses the IPR protection survey variable representing the degree of IPR protection in each country which is categorized by the specific characteristics of countries. The Conflict and Balance Between intellectual property rights and Public Freedom of Information in the“Anti-circumvention Clause”

There is a long-standing conflict between intellectual property rights and public freedom of *** continuous development of the“anti-circumvention clause”has caused the conflict to *** a basic human right,freedom of information is being gradually eroded by the expansion of intellectual property *** existing research mainly carries on the right balance from the negative protection path,but the positive protection path is more advantageous to realizing the public freedom of information and alleviates the conflict between the two kinds of *** practice,there are some problems in the application of the anti-circumvention clause,such as the legality of the aim,the division of the protected part,and the determination of the *** is mainly due to the lack of restrictions on technical measures,the failure to distinguish between“copyright protection”and“contact control”,and the offside and absence of administrative bodies in *** should protect public freedom of information by distinguishing the two measures of copyright protection and contact control and the two torts of access and use,increasing the restrictive conditions for the use of technical protection measures,and changing the functions of administrative supervision agencies.

Among the multifarious systems of civil law rights, intellectual property rights （IPR） score relatively high in terms of scientific and technological content and knowledge factors. It is generally accepted that copyright occurs in the realm of cultural creation, and is closely related to cultural innovation and the culture industry; patent rights arise in the field of technical applications, and are closely allied with technical innovation and the technology industry; and trademarks function in the area of business operations and involve a number of issues such as product sales and market trading. In the knowledge-based economy, the implementation of an IPR system can have a profound impact on a country＇s economic development, technological progress, and cultural and educational prosperity. And in the context of economic globalization, IPR protection also involves international politics and trade as well as cultural and technological exchanges and cooperation between *** is therefore both important and necessary for us to explore the attributes of IPR from the perspective of civil law, and to examine the functions of IPR from the multiple perspectives of human rights theories, economics, management and policy science. This helps us reveal the basic meaning of intellectual property rights from different disciplinary perspectives, and to maintain problem orientation and methodological openness in IPR research.

Recently creative industry tends to cluster mainly in large and medium *** paper provides an empirical analysis of the relationship between intellectual property right protection and industrial agglomeration across 31 provinces over a period of six years from 2003 to *** analysis not only constructs a new theoretical framework to prove the invert U-shaped relationship but remedies the absent of econometric *** the same time,this paper also analyses the empirical explanation of the determinants of creative industrial *** results show that consumption expenditure,government policy,creative class and cultural endowment have been found as common factors of *** these determinants,intellectual property rights play very important *** addition,the model predicts an inverted U relationship between the intellectual property right protection and industrial agglomeration.

Areas of priority for intensive discovery would be the agbiotechnology and biomedical sectors using gene technology as a platform. The use of genetic manipulation in farming and the use of plants as ‘pharma’ factories to manufacture therapeutics would be on the rise. The human genome will continue to have a powerful impact on research and development of human diseases and healthcare. Discovery of genetics and pharmacogenomics will have great impact on drug development and will allow the prediction of the patient's response to various drugs as well as the onset of individualised or ‘designer drugs’. Human stem cells could have their cellular clocks reset by the cloning process, enhancing opportunities to grow young cells, tissues and organs for an aging population. The cellular clock could also be reset by therapeutic cloning. Bioinformatics would be a technology which would be synonymous with biotechnology. The analyses of biotechnology research would be conducted in silico and would involve the exchange of information among sophisticated computer databases. Applications of biotechnology would be even more evident in environmental technology, food development and food processing. In electronics, the use of the specificity of proteins in biochips is underway. In tandem with the explosions in research, regulatory issues, legislation and intellectual property rights will evolve to enhance the climate of discovery and innovation. Public education will have to be continually enhanced as awareness could negate any fear resulting from novel and innovative improvements from biotechnology.

Diversification of procedural and administrative costs and innovation:Some firm-level evidence

We examine the diversification of administrative and procedural costs on patent stock using a large dataset from the European Patent Office with 15,000 firms for the period between 1995 and *** results reveal that administrative and procedural costs are significant for firm-level patenting ***,not all administrative and procedural costs have equal *** administrative costs often encourage patent application and validation by solving the adverse selection problem and short-run opportunism,as well as other sources of asymmetric *** effective administration of intellectual property law and low-cost enforcement are found to considerably foster patenting *** effects are robust for various mis-specification checks and do not disappear once country-level research and development infrastructure proxies are controlled *** extreme bounds of administrative and procedural costs are computed across more than 5 billion regressions,and the sizeable impact of administration on patent application and validation outcomes is confirmed.
