监察证据与刑事证据衔接的理论和实践反思

监察体制改革全面推开以来,涉及职务犯罪的刑事诉讼程序日趋呈现“监察主导”的态势,监察权主体对于被调查人“入罪”或者“出罪”乃至整个刑事案件走向的把控具有相当的前端主导力,这在客观上加剧了外界对监察证据的过度焦虑。监察证据因其所处的程序环境特殊而与刑事证据存在诸多不同,传统的刑事证据理论站在诉讼法的立场对“前监察时代”的纪委办案证据有着较为成熟的制度安排和理论自信,却在崭新的监察权面前缺乏解释的张力。司法实践中监察证据与刑事证据一体互认的默契正在形成,与其固守刑事证据在法律规定层面上的“纸面优势”,倒不如强化和完善监察证据的取证规范,提高监察证据的质量,探索一条既能守牢权利保障底线,又能满足现实办案需要的中间道路,最终实现职务犯罪刑事司法的公平公正。

Deployment of multiple radio access technologies(RATs) at the same cell site enables the system to flexibly support different types of devices and services. Such multi-RAT systems call for an efficient utilization of the system resources as well as simplified management. In this paper, we take a user-centric approach and let each individual user equipment decide its own access strategy in a multi-RAT system with regulated interference constraints. The formulated problem is a generalized Nash equilibrium(GNE) problem. We show that there always exists a GNE but its uniqueness is not guaranteed. A closed form solution is provided to characterize a special class of the GNEs. We then propose a primal-dual algorithm with detailed convergence analysis for computing a GNE. The proposed algorithm may have practical implications in the design of multi-RAT systems.

The squeezed back-to-back correlation(SBBC)of a boson-antiboson pair is sensitive to the time distribution of the particle-emitting source,and the SBBC function for an evolving source is expected to be affected by the relaxation time of the *** this study,we investigated the effect of relaxation time on the SBBC *** propose a method for calculating the SBBC function with relaxation-time approximation for evolving *** functions of D^(0)D^(-0)in relativistic heavy-ion collisions were investigated using a hydrodynamic *** found that the relaxation time reduces the amplitudes of the SBBC *** becomes apparent for long relaxation times and large initial relative deviations of the chaotic and squeezed amplitudes from their equilibrium values in the temporal steps.

A novel compound 4-methyl-7-{[4-（2,2＇：6＇,2＂-terpyridin-4＇-yl）benzyl]amino}-2H-chromen-2-one（1） was synthesized, and its DNA-binding properties, cytotoxicity, and telomerase and Topo I inhibitory activities were evaluated. For comparison, the anti-proliferative and Topo I inhibitory activities of another two analogues 2 and 3 were also investigated. Compound 1 is able to stabilize the structures of human telomere（h-tert） and promoter（c-myc and c-kit2） G-quadruplexes and h-tert i-motif. The association constants（Kb） are about 106 L/mol for h-tert G-quadruplex and/-motif, while the values are about l0s L/mol for both promoter G-qaudruplexes and calf thymus DNA（ct-DNA）. The binding of compound 1 induces the change of h-tert G-quadruplex from hybrid to antiparallel structure and exhibits 88.7% inhibition of telomerase activity at 8 μmol/L. Both compounds 1 and 3 inhibit signifi- cantly Topo I-mediated relaxation of pBR322 DNA. Compounds 1 and 2 show a high inhibitory efficacy on HepG2 and MCF-7 cancer cell lines with IC50 values of about 10^-6 mol/L. The three compounds also induce a delay of cell cycle progression. The coumarin group is vital for improving the biological activity ofterpyridine derivatives.

To celebrate the 90th birthday of Professor Mooson Kwauk, who supervised the multi-scale research at this Institute in the last three decades, we dedicate this paper outlining our thoughts on this subject accumulated from our previous studies. In the process of developing, improving and extending the energy- minimization multi-scale （EMMS） method, we have gradually recognized that meso-scales are critical to the understanding of the different kinds of multi-scale structures and systems. It is a common challenge not only for chemical engineering but also for almost all disciplines of science and engineering, due to its importance in bridging micro- and macro-behaviors and in displaying complexity and diversity. It is believed that there may exist a common law behind meso-scales of different problems, possibly even in different fields. Therefore, a breakthrough in the understanding of meso-scales will help materialize a revolutionary progress, with respect to modeling, computation and application.

Transition metal phosphides(TMPs)are recognized as such promising supercapacitor materials for the practical application,due to their superior electrical conductivity and excellent redox ***,self-supported three-dimensional NiCoP nanoparticles embedded in NiCoO2 nano wires(NiCoO2/NiCoP)electrode consisting of nickel cobalt phosphides(NiCoP)with high activity and nickel cobalt oxides(NiCoO2)with good stability were fabricated by a hydrothermal and phosphorization *** electrode integrates the advantages of nanowire arrays for fast ion transport and foam Ni for effective charge transport and *** the proper composition control of the nanohybrid and unique structure design,the optimized NiCoO2/NiCoP-20 exhibits a high specific capacitance of 3204 F·g-1 at 1 A·g-1 in 3 mol·L-1 KOH aqueous electrolyte in a three-electrode ***,the asymmetric supercapacitor assembled with the prepared NiCoO2/NiCoP-20 and activated carbon achieves a specific capacitance of 116 F·g-1 with a high energy density of 40.32 Wh·kg-1 at the power density of 800.18 W·*** practical application is further demonstrated with all-solid-state winding supercapacitor devices,with decent flexibility,in series to light the Central South University(CSU)logo consisting of 21 red LED indicators.

为揭示SUS321不锈钢的力学性能与其热处理工艺之间的复杂关系,基于随机森林模型,通过机器学习方法建立了退火温度、退火时间与SUS321不锈钢力学性能的预测模型。结果表明,模型对SUS321不锈钢抗拉强度、屈服强度和伸长率的预测性能指标R^(2)均超过0.8,表现出较好的预测效果。基于部分依赖图和个体条件期望图的分析表明,随退火温度和退火时间的增加,SUS321不锈钢的抗拉强度和屈服强度呈现下降趋势,而伸长率呈现上升趋势,且退火温度为主要特征参数。

The deformations of light Λ hypernuclei are studied in an extended nonrelativistic deformed Skyrme-Hartree-Fock approach with realistic modern nucleonic Skyrme forces,pairing correlations,and a microscopical lambda-nucleon interaction derived from Brueckner-Hartree-Fock *** to the large effect of an additional Λ particle on nuclear deformation in the light soft nuclei within relativistic mean field method,this effect is much smaller in the nonrelativistic mean-field approximation.
