《民法总则(草案)》中法律行为制度的创新点之评价

《民法总则(草案)》纠正了《民法通则》对法律行为性质的错误定性,将"乘人之危"与"显失公平"正确地并合,增设了"虚假表示"和"第三人欺诈"的行为种类,增设了撤销权的除斥期间及撤销权放弃规则,正确地否定了当事人对可撤销行为所享有的"变更权",并在法律行为效力相关问题上对现行制度进行了适当的调整,包括增加了有关法律行为无效之无对抗力的规定等,从整体上推进了法律行为制度的科学化。但草案根据法律行为是否具有相对人而分别规定不同的解释原则,在法律行为的解释规则设计上存在重大失误,应直接以《合同法》所规定的合同解释规则予以替换。

在中国,民法调整对象的立法确认过程,就是中国民法获得其生存和发展空间的历史过程,也是民法挣脱公法的束缚争取其独立地位的过程,而1986年《民法通则》在公法与私法划分理论的基础上所作出的有关民法调整对象的立法表达,正是这一艰苦斗争历程的辉煌成果。它不仅为中国民法在其后的发展奠定了坚实的基础,而且为1999年新《合同法》的制订,扫清了最为主要的立法障碍。但是,导致早期经济法理论崩溃的决定性力量,是迅猛发展的经济体制改革之社会实践本身。2007年颁布的《物权法》模糊并扩大了调整对象范围,进入了大量的公法规则,有可能为中国未来民法典的制订再度形成新的障碍,这一障碍的克服,依赖于经济体制改革的进一步深化。

近代大陆民法法典化运动,反映了近代社会理性主义的思想基础和法制统一的政治需要以及法律科学化追求,但现代社会的多样性需求所导致的民法形式的多样化以及司法解释或判例规则所具有的实体法功能,却形成了反法典化的思潮。但民法法典化与反法典化的差异,归根结底是一个技术层面的问题而非本质层面的问题。中国民法必须法典化的根本原因,主要不在于实现民法规则的体系性、科学性和逻辑性,而在于对民众心理所发生的巨大影响及对于中国政治民主和法治进程的巨大推动。

Heterogeneous interfaces produced by interdomain interactions on a nanoscale performs a crucial role in boosting the properties of an electrocatalyst toward oxygen evolution reaction(OER)***,a series of dual-phase electrodes with intimately connected heterointerfaces are prepared by in situ decomposing solid solution oxide of Ni_(x)Co_(y)Fe_(100-x-y)O,which grew on Ni foam massively via an ultrafast combustion ***,with high-reaction kinetics caused by the reduction treatment at 450℃,the less electronegative Fe and Co are more oxyphilic than Ni,which facilitated their co-exsolution and formation of CoFe_2O_4/NiO oxide with enriched oxygen *** from the nanoporous framework,heterojunction structure,and oxygen defects,the self-supporting electrodes present rapid charge/mass transmission and provide abundant active sites for *** optimized sample(R-SNCF4.5)shows low overpotentials of 226 and 324 mV at 10 and100 mA·cm^(-2),a small Tafel slope(46.7 mV·dec^(-1)),and excellent *** assembled R-SNCF4.5//Pt/C/NF electrolyzer demonstrates continuous electrolysis over 50 h at a current density of 10 mA·cm^(-2),under 1.51 *** functional theory(DFT)calculations verify that the strong electronic modulation plays a critical part in the CoFe_2O_4/NiO hybrid by lowering the energy barriers for the ratedetermining steps,and Fe sites are the most active OER sites.

昆山市吴淞江大桥主桥为2×101 m的塔梁墩固结体系斜拉桥,为满足升级到Ⅲ级航道的通航要求,需将全桥整体顶升抬高1.87 m。该桥采用整体同步顶升方案施工,其中两侧引桥先采用断柱顶升法施工,主桥后采用抬梁顶升法施工。在主桥整体顶升中,首先在主墩墩底以上1 m处施工托换结构(由抬梁和抱柱梁组成),并将原桥墩内部空心部位用C50灌浆料填充密实;托换结构施工后,安装液压自锁式千斤顶和跟随千斤顶,同步进行主墩及过渡墩墩柱切割;墩柱切割后将主墩处主梁放置在托换结构上,过渡墩处主梁直接放置千斤顶上,通过PLC同步控制系统顶升桥梁至设计标高;最后,对主墩及过渡墩墩柱进行接高及加粗,完成1.87 m接高区段墩柱连接。

Membrane-based separation is a promising technology to eliminate water impurities from the oil ***,it remains a great challenge to separate water from highly emulsified viscous oil owing to the high stability of the water droplets in *** we report a surface wettability engineering on an alumina ceramic membrane to achieve an efficient separation of a water-in-oil(W/O)*** with different carbon chain lengths and fluorinated status were introduced to endow the alumina membrane with different surface *** all the modified membranes exhibited excellent separation of the W/O without Span 80(surfactant),the one with amphiphobic wettability and lowest surface energy failed to separate the Span 80 stabilized W/*** presence of Span 80 reduced the interfacial tension of water droplets,making them easier to deform and penetrate the modified membrane with the lowest surface *** reveals that engineering proper surface wettability is the key to separating the oil and water ***,the modified membranes maintained decent separation performance and stability under long-term run separation of the emulsified W/O.

Achieving seedlessness in citrus varieties is one of the important objectives of citrus *** sterility associated with abnormal pollen development is an important factor in ***,our understanding of the regulatory mechanism underlying the seedlessness phenotype in citrus is still ***,we determined that the miR159a-DUO1 module played an important role in regulating pollen development in citrus,which further indirectly modulated seed development and fruit *** the overexpression of csi-miR159a and the knocking out of DUO1 in Hong Kong kumquat(Fortunella hindsii)resulted in small and seedless fruit ***,pollen was severely aborted in both transgenic lines,with arrested pollen mitotic I and abnormal pollen starch *** additional cross-pollination experiments,DUO1 was proven to be the key target gene for miR159a to regulate male sterility in *** on DNA affinity purification sequencing(DAP-seq),RNA-seq,and verified interaction assays,YUC2/YUC6,SS4 and STP8 were identified as downstream target genes of DUO1,those were all positively regulated by *** transgenic *** lines,the miR159a-DUO1 module down-regulated the expression of YUC2/YUC6,which decreased indoleacetic acid(IAA)levels and modulated auxin signaling to repress pollen mitotic *** miR159a-DUO1 module reduced the expression of the starch synthesis gene SS4 and sugar transport gene STP8 to disrupt starch metabolism in ***,this work reveals a new mechanism by which the miR159a-DUO1 module regulates pollen development and elucidates the molecular regulatory network underlying male sterility in citrus.
