XI Jinping,General Secretary of Central Committee of the Communist Party of China(CPC),made an important speech(Speech)on China’s path of advancement of human rights at a group study session of the Political Bureau of the CPC Central Committee on February 25,*** to law-based protection of human rights and improvement of the legal mechanism of protection of human rights are important requirements for firmly following China’s path of human rights *** improve the law-based mechanism of guarantee of human rights,the principles of respecting the people’s principal position and removing systematic and institutional barriers should be adhered *** Constitution should be comprehensively implemented to promote record and review of new laws presented by legislatures,and to safeguard its *** of human rights theory should be accelerated,along with faster construction of a human rights academic system,of a human rights academic system,and of a human rights discourse system,for meeting China’s needs in the new era.A sound legal mechanism of guarantee for human rights can better guarantee people’s better ***,China should actively participate in global human rights governance and make appropriate contributions.

China has a long history of constitutional jurisprudence, bearing different academic missions in different eras. China’s constitutional jurisprudence, characterized by its academic logic and principled nature, has not only facilitated social development and progress but also actively played academic functions during the Chinese reform and opening up. This paper considers the social changes during the last 40 years of the policy’s implementation as the background and, by employing standardized and literature analysis methods, combs the main progress and evolution of the knowledge system during the 40 years of constitutional jurisprudence study, followed by a look into its future.

Asia is no longer a concept in its economic, cultural and geographical sense. It has become a regional community that has had an important impact on the human rights development in the world. In the 21 st century filled with challenges and hopes, people want to see not only an economically prosperous Asia but also an Asia community with increasing humanistic spirit and pursuit for constitutionalist values.

On March 14,2004,the Second Session of the 10th National People’s Congress of China adopted the fourth amendment to the Chinese Constitution,the most noticeable highlight of which is the addition of the paragraph“the state respects and protects human rights”as the third clause in Article 33 of Chapter II“Basic Rights and Obligations of Citizens”in the *** inclusion of the clause of human rights in the Constitution is considered an important milestone in the history of human rights development in the People’s Republic of *** implementation of the human rights clause not only showcases the values of the Party and the state in respecting and protecting human rights,but also promotes the development of human rights,shapes the culture of human rights,and endows the rule of law with a rich humanistic *** the past 20 years,the publicity,research and practice of the human rights clause have made the Chi-nese people realize that human rights are not only a“great term”,but also a common value shared by *** the once-in-a-century changes of the world,although the development of human rights is facing various challenges,the humanistic spirit contained in the hu-man rights clause has become the internal driving force for building consensus in the whole of *** the significance and value of the human rights clause can help us conscientiously draw on the experience in the implementation of the clause over the past 20 years and contribute Chinese wisdom and experience to global human rights governance with a more open mind and inclusive attitude.

One of the cooperations that I attached great importance to was the young scholar joint research program on intemet regulation established towards the end of my Deanship between our law school and the LMU Munich Faculty of Law. Therefore, I was very delighted to join, together with Prof. Dr. Dieter Grimm, their first workshop in Beijing in April 2017; and I am even more delighted to see the fruits of this project will be published in both China and Germany now.

现行宪法为推进中国式现代化提供了坚实的宪法依据、有机统一的宪法规范体系和宪法保障体系。从中华人民共和国成立初期“社会主义工业化”“四个现代化”入宪,到改革开放后“社会主义现代化建设”入宪,再到形成以“社会主义现代化强国”为核心的宪法规范体系,现代化话语贯穿于我国宪法制定、修改与实施的历史进程。宪法序言中的历史叙事和对国家目标的表达,明确了中国式现代化的规范语境。宪法正文中的基本国策规范、基本权利规范、国家机构规范等,为保障中国式现代化的推进提供了规范基础。全面实施宪法,既是中国式现代化的应有之义,也是中国式现代化的有效保障。为更好发挥宪法对中国式现代化的规范和保障作用,应认真对待宪法文本,体系性地运用宪法解释学方法,深挖宪法基础范畴与概念,建构具有历史意识、面向现代化实践的中国宪法理论体系。

在清末新政的背景下,"比较宪法"一词首次出现于《译书汇编》1901年第6期,此后陆续出现于晚清时期的报纸期刊、学术著作和法政学堂。在清末民初这一阶段,比较宪法概念虽大致确立,但内涵限于外国宪法著作和文本的翻译。但1930年前后出版的以比较宪法为主题的著作凸显了中国比较宪法概念的主体性内涵。1949年后,比较宪法概念并没有随着六法全书的废除而中断,而继续以多种形式延续。

2005年2月24日,国务院发布的《关于鼓励支持和引导个体私营等非公有制经济发展的若干意见》明确提出了放宽非公有制经济市场准入限制、加大对非公有制经济的财税金融支持等鼓励、支持和引导非公有制经济发展的七大政策措施。《意见》的发布,对于进一步贯彻落实中共十五大特别是十六大以来关于鼓励和促进非公有制经济发展的一系列方针政策,落实2004年宪法修正案关于完善保护私有财产法律制度的要求,切实解决我国非公有制经济发展面临的观念、法律、体制等方面的困难和问题,具有非常深远的现实意义和历史意义。为此,本刊特开辟专栏——"非公有制经济的平等保护",约请知名法学专家、学者就此问题从法律的角度进行探讨。
