女友和母亲同时落水应该先救谁?刑法对此问题的回答实际上是对不纯正不作为犯罪的等值性进行判断。不纯正不作为犯罪与作为犯罪之间的等值性判断需要经过形式和实质两个阶段。在形式判断阶段,刑法理论中的"法律规定的义务""职务上的义务""先前行为引起的义务"等形式上的义务类型是等值性判断的起点而非终点,对符合某种义务类型的不作为仍需根据具体情况做进一步实质的价值评判。如果义务主体对法益侵害因果流程的干预义务具有规范意义上的排他性,则可以肯定不作为与作为的等值性。如果多个义务主体同时存在,则每个义务主体的不作为都会因干预义务的排他性消失而失去与作为犯罪的等值性。

In the summer of 2020,a super Meiyu event occurred in the Yangtze River basin(YRB),causing enormous economic losses and human casualties.Recent studies have investigated the possible causes of this super Meiyu event from the perspective of anomalous atmospheric circulation activities and sea surface temperature(SST)anomalies;however,the influence of land surface processes has not garnered considerable attention.This study investigates the possible contributions of land surface processes to this extreme event based on observational analysis and numerical simulations,and shows that antecedent soil moisture(SM)anomalies over the Indo-China Peninsula(ICP)may have had a vital influence on the super Meiyu in 2020.Negative SM anomalies in May over the ICP increased the surface temperature and sensible heat flux.The“memory”of soil allowed the anomalies to persist into the Meiyu period.The heating of the lower atmosphere by the surface strengthened the western Pacific subtropical high,which caused an anomalous anticyclone from the ICP to Northwest Pacific and thus enhanced the southwesterly winds and vertical motion over the YRB.Consequently,the water vapor flux and convergence were strengthened.Sensitivity experiments based on the Weather Research and Forecasting(WRF)model further confirmed the results of observational analysis and indicated that the warm air heated by the ICP surface significantly warmed the lower troposphere from the ICP to Northwest Pacific under the influence of the background wind,thus increasing the geopotential height and inducing an anticyclone.The results of the sensitivity experiments showed that the SM anomalies in May over the ICP increased the precipitation by 10.6%from June to July over the YRB.These findings can improve our understanding of the mechanism of the super Meiyu event in 2020 and facilitate the prediction of extreme Meiyu events.

INTRODUCTION Patients with an acute minor ischaemic stroke or high-risk transient ischaemic attack(TIA)had a higher risk of recurrent stroke within 3 months after onset.Dual antiplatelet therapy(DAPT)with clopidogrel and aspirin was more effective than aspirin alone for reducing subsequent events in this patient population in the Clopidogrel in High-Risk Patients with Acute Nondisabling Cerebrovascular Events(CHANCE)and the Platelet-Oriented Inhibition in New TIA and Minor Ischaemic Stroke(POINT)trials.

In this paper, we propose a K-means clustering-based integral level-value estimation algorithm to solve a kind of box-constrained global optimization problem. For this purpose, we introduce the generalized variance function associated with the level-value of the objective function to be minimized. The variance function has a good property when Newton’s method is used to solve a variance equation resulting by setting the variance function to zero. We prove that the largest root of the variance equation is equal to the global minimum value of the corresponding optimization problem. Based on the K-means clustering algorithm, the multiple importance sampling technique is proposed in the implementable algorithm. The main idea of the cross-entropy method is used to update the parameters of sampling density function. The asymptotic convergence of the algorithm is proved, and the validity of the algorithm is verified by numerical experiments.

Object detection is widely used in object tracking;anchor-free object tracking provides an end-to-end single-object-tracking approach.In this study,we propose a new anchor-free network,the Siamese center-prediction network(SiamCPN).Given the presence of referenced object features in the initial frame,we directly predict the center point and size of the object in subsequent frames in a Siamese-structure network without the need for perframe post-processing operations.Unlike other anchor-free tracking approaches that are based on semantic segmentation and achieve anchor-free tracking by pixel-level prediction,SiamCPN directly obtains all information required for tracking,greatly simplifying the model.A center-prediction sub-network is applied to multiple stages of the backbone to adaptively learn from the experience of different branches of the Siamese net.The model can accurately predict object location,implement appropriate corrections,and regress the size of the target bounding box.Compared to other leading Siamese networks,SiamCPN is simpler,faster,and more efficient as it uses fewer hyperparameters.Experiments demonstrate that our method outperforms other leading Siamese networks on GOT-10K and UAV123 benchmarks,and is comparable to other excellent trackers on LaSOT,VOT2016,and OTB-100 while improving inference speed 1.5 to 2 times.

To understand the contribution of new particle formation(NPF)events to ambient fine particle pollution,measurements of particle size distributions,trace gases and meteorological conditions,were conducted at a suburban site(NJU)from October to December 2016 and at an industrial site(NUIST)from September to November 2015 in Nanjing.According to the temporal evolution of the particle size distributions,three types NPF events were observed:typical NPF(Type A),moderate NPF events(Type B)and strong NPF(Type C)events.The favorable conditions for Type A events included low relative humidity,low concentration of pre-existing particles,and high solar radiation.The favorable conditions of Type B events were similar to Type A,except for a higher concentration of pre-existing particles.Type C events were more likely to happen with the higher relative humidity,lower solar radiation and continuous growth of pre-existing particle concentration.The formation rate of 3 nm(J3)was the lowest for Type A events and highest for Type C events.In contrast,the growth rates of 10 nm and 40 nm particles were the highest for Type A,and lowest for Type C.Results show that NPF events with only higher J3 would lead to the accumulation of nucleation mode particles.Sulfuric acid was important for the formation of particles but had little effect on the growth of particle size.

Prognostic Factors of Liver Transplantation for Hepatocellular Carcinoma: A Surveillance, Epidemiology, and End Results (SEER) Database Analysis

Objective We aimed to identify new,more accurate risk factors of liver transplantation for liver cancer through using the Surveillance,Epidemiology,and End Results(SEER)database.Methods Using the SEER database,we identified patients that had undergone surgical resection for non-metastatic hepatocellular carcinoma(HCC)and subsequent liver transplantation between 2010 and 2017.Overall survival(OS)was estimated using Kaplan-Meier plotter.Cox proportional hazards regression modelling was used to identify factors independently associated with recurrent disease[presented as adjusted hazard ratios(HR)with 95%CIs].Results Totally,1530 eligible patients were included in the analysis.There were significant differences in ethnicity(P=0.04),cancer stage(P<0.001),vascular invasion(P<0.001)and gall bladder involvement(P<0.001)between the groups that survived,died due to cancer,or died due to other causes.In the Cox regression model,there were no significant differences in OS at 5 years with different operative strategies(autotransplantation versus allotransplantation),nor at survival at 1 year with neoadjuvant radiotherapy.However,neoadjuvant radiotherapy did appear to improve survival at both 3 years(HR:0.540,95%CI:0.326–0.896,P=0.017)and 5 years(HR:0.338,95%CI:0.153–0.747,P=0.007)from diagnosis.Conclusion This study demonstrated differences in patient characteristics between prognostic groups after liver resection and transplantation for HCC.These criteria can be used to inform patient selection and consent in this setting.Preoperative radiotherapy may improve long-term survival post-transplantation.

To alleviate the secondary contamination of our environment when using quantum dots(QDs) to detect the organophosphorothioate pesticides(OPPs),we herein report a strategy to assemble magnetic Fe_(3)O_(4) nanoparticles and luminescent Cd Te quantum dots(QDs) into a composite nanosystem,which possesses both the magnetic property of Fe_(3)O_(4) nanoparticles and the luminescent character of Cd Te QDs,for the detection of chlorpyrifos,one of the typical OPPs.This strategy involves the isolated synthesis of magnetic Fe_(3)O_(4) nanoparticles with positive charges and luminescent Cd Te QDs with negative charges,and their subsequent assembly by electrostatic interaction.The as-prepared Fe_(3)O_(4)-Cd Te nanocomposites have a detection limit as low as 10 ppb for chlorpyrifos,and are also selective for the OPPs with a phosphorothioate moiety(P=S bond).In specific,the Fe_(3)O_(4)-Cd Te nanocomposites can be conveniently harvested by a normal magnet,and the recycling rate for both Cd and Fe determined by inductively coupled plasma atomic emission spectroscopy(ICP-AES) is higher than 96%,showing great potential in alleviating the Cd pollution on the environment.
