摘      要：以ChatGPT为代表的生成式AI带来了内容领域的全新创作方式,人工智能生成内容的可版权性成为知识产权法学界的热议话题。在思想与表达的二分法、独创性和固定性判断标准面前,人工智能生成内容与著作权法的作品构成要件相契合。在当下的读者中心主义和作品商品化趋势大潮下,著作权法成为规制和保护AI创作的最佳路径。The emergence of generative AI, represented by ChatGPT, has brought about a new mode of content creation in the field of content, the copyrightability of AI-generated content is a hot topic in the field of intellectual property law. In terms of the standards of dichotomy, originality and fixity between ideas and expressions, AI-generated content meets the requirements of copyrightable subject matter. In the current trend of reader-centeredness and commodification of works, copyright has become the best path to regulate and protect AI creations.
