佛山市企业商标保护现状与对策建议

摘 要：商标是企业的无形资产。通过调查近三年佛山市商标数据可以发现,佛山市企业的商标注册数量和商标侵权案件的审理数量都在逐年增长且每年都居于全省前列。与此同时,目前佛山市企业商标的保护工作仍然存在着不足之处,主要集中在权利人自我维权意识不足、海外商标抢注问题较为突出、商标侵权案件的处理周期较长等三大方面。针对现存问题,建议完善《商标法》在企业商标保护方面的不足、加强工商行政管理部门的监管力度、强化商标权利人的维权意识、防范商标海外抢注风险。Trademarks are intangible assets of enterprises. By investigating the trademark data of Foshan City in the past three years, it can be found that the number of trademark registrations and the number of trademark infringement cases in Foshan City are increasing year by year and are at the forefront of the province every year. At the same time, there are still some deficiencies in the protection of enterprise trademarks in Foshan City, mainly focusing on the lack of self-protection awareness of rights holders, the prominent problem of overseas trademark squatting, and the long processing cycle of trademark infringement cases. In view of the existing problems, it is suggested to improve the deficiency of ‘Trademark Law in the protection of enterprise trademarks, strengthen the supervision of industrial and commercial administrative departments, strengthen the awareness of trademark rights holders, and prevent the risk of overseas trademark squatting.
